SUBJECT: BY-LAW NUMBER 16-83:
THE CORPORATION OF THE CITY OF OSHAWA
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-32-83 be received; and
2. That By-law 16-83 of the City of Oshawa be
received and filed.
BACKGROUND AND COMMENTS:
By-law Number 16-83 of the City of Oshawa was forwarded to
the Planning and Development Department on January 31 , 1983.
The subject By-law amendment changes the zoning of a parcel
of land located on the west side of Harmony Road North,
north of Rossland Road East, within the City of Oshawa. The
By-law changes the zoning of this parcel of land from "BR"
to "Special Condition 126" in order to permit the
development of seventy-five (75) dwelling units in the form
of group dwellings. This By-law amendment covers an area of
the City of Oshawa which would have no detrimental effect on
the Town of Newcastle, and, therefore, no further action on

this amendment is required. However, we note that the last
date for filing objections was February 16, 1983.

CORPORATION OF THE CITY OF OSHAWA FOR APPROVAL OF A BY-LAW TO
REGULATE LAND USE PASSED PURSUANT TO SECTION 39 OF THE PLANNING
ACT
TAKE Nc"7PICE that the Council of The Corporation of the City of Oshawa intends to
apply to The Ontario Municipal Board pursuant to the provisions of Section 39 of
The Planning Act for approval of By-law Number 16-83 passed on the 24th day of
January 1983. A copy of the by-law is furnished herewith. A note giving an
explanation of the purpose and effect of the by-law and stating the lands affected
thereby is also furnished herewith.
ANY PERSON INTERESTED MAY within twenty-one (21) days after the date of this
notice, send by registered mail or deliver to the Clerk of the City of Oshawa
notice of objection to approval of the said by-law or part thereof giving details
of all or the portion of the by-law to which you object and detailed reasons
therefor, and shall indicate that if a hearing is held the objector or an agent
will attend at the hearing to support the objection.
ANY PERSON wishing to support the application for approval of the by-law may
within twenty-one (21) days after the date of this notice send by registered mail
or deliver to the Clerk of the City of Oshawa notice of his support of approval of
the said by-law together with a request for notice of any hearing that may be held
giving the name and address to which such notice should be given.

THE CNTARIO MUNICIPAL BOARD may approve of the said by-law but he fore doing so it
may appoint a time and place when any objection to the by-law will be considered.
Notice of any hearing that may be held will he qiven only to persons who have
filed an objection or notice of support and who have left with or delivered to the

Clerk undersigned, the address to which notice of hearing is to be sent and
similarly, to any person who has filed a request for a change in the provisions of
the by-law.

being a by-law to further amend By-law Number 3415 of the City of
Oshawa.
BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law

of The Corporation of the City of Oshawa by the Council thereof as
follows:
1 . By-law Number 3415 be and the same is hereby further
amended by adding to Schedule "A" thereof Special Condition "126"
as set out in Schedule "B" to 'th.is by-law.
2. Sheet Number 3 of Appendix "A" to By-law Number 3415, as
amended, is hereby further amended by changing the land use
designation for an irregular parcel of land, located on the west
side of Harmony Road North, north of Rossland Road having a
frontage of approximately 250 metres on Harmony Road North, from
BR (Buffer) to make the lands subject only to Special Condition
11126" so that Sheet Number 3 shall be amended as shown on the
j revised Sheet Number 3 attached hereto as Schedule "A" .
� 3, The land described in paragraph 2 above and made subject �

to Special Condition "126" is hereby declared to be a site plan
e control area within the meaning of subsection 2 of Section 40 of
the Planning Act R.S.O. 1980 C. 379, as amended.

4, The Plan attached hereto as Schedule "C" shall form
Appendix "A" to Special Condition "126" .

S. Schedules "A" , "B" and "C" attached hereto shall form
part of this by-law.
6. Paragraph 3 of this by-law shall take effect from the
date of passing of this by-law, No other part of this by-law
shall come into force without the approval of the Ontario

Municipal Board but subject thereto this by-law shall take effect
from the date of its passinq.

SPECIAL CONDITION 11126"
The parcel of land located at 700 Harmony Road North, as shown on
F
Schedule "A" to this by-law hatched and marked with the figures
11126" encircled shall be subject only to the special provisions '
and definitions hereinafter contained.
1. Definitions
I
For the purpose of interpreting the 'provisions set forth in
this by-law, the following definitions shall apply:
1.1 "Landscaped Open Space" means open unobstructed space
on a lot which is suitable for the growth and
maintenance of grass, flowers, shrubs and other
landscaping and notwithstanding the foregoing includes
any Surfaced walk, patio, tennis court or similar

recreational area and any pond, swimming or decorative
i
pool, but does not include any parking space, aisle,
driveway or any loading area.

1 .2 The Definitions contained in Section 1 of By-law 55-73
and in Section 2 of By-law 3415 as amended shall apply,.,
to the regulations hereinafter set out.
2. Permitted Uses

2.1 One or more group dwellings shall be permitted on the
lands subject to this Special Condition.

3. Dens it
3.1 Not more than seventy-five (75) dwelling units shall be
permitted on the lands subject to this Special
Condition
4. Lot Coverage
4.1 Not more than 30% of the total area of the lands
subject to this Special Condition shall be covered with
buildings.
5. Building Area
5.1 No building shall he permitted on the lands subject to
this Special Condition except within the area shown
hatched and indicated as "building Area" on Appendix
"A" to this Special Condition.
5.2 Notwithstanding the provisions of Section 5.1 to the
contrary, open and unenclosed porches, balconies, decks
and steps may project a maximum distance of 1.5 metres
beyond the area shown hatched and indicated as

"Building Area" on Appendix "A" to this Special
Condition.

6. Height
i
6.1 No building or structure erected on any part of the
a lands subject to this Special Condition shall exceed
10.5 metres in height.

7. Landscaped Open Space
7.1 Not less than 50% of the lands which are subject to
this Special Condition shallibe used for any purpose

8. Off-Street Parking
8.1 A minimum of 169 parking spaces shall be provided on
the lands subject to this Special Condition of which 75
spaces shall be provided in an enclosed garage,

internal to a dwelling unit, 75 spaces shall be
provided on a paved driveway leading to a garage and 19
spaces shall be provided only for parking for
visitors.

EXPLANATION OF THE PURPOSE AND EFFECT OF BY-LAW NUMBER 16-83

By-law Number 16-83 changes the land use designation for a parcel
of land on the west side of Harmony Road North north of Rossland
Road East shown hatched on Schedule "A" to By-law 16-83 from BR to
Special Condition 11126" to implement a draft plan of condominium
for the development of a maximum of seventy-five (75) dwelling
units in the form of group dwellings.
