SUBJECT: BY-LAW NUMBER 156-82:
THE CORPORATION OF THE CITY OF OSHAWA
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-18-83 be received; and
2. That By-law 156-82 of the City of Oshawa be
received and filed.
BACKGROUND AND COMMENTS:
By-law Number 156-82 of the City of Oshawa was forwarded to
the Planning and Development Department on January 14, 1983.
The subject By-law changes the zoning of a parcel of land
located on the west side of Thornton Road North, immediately
north of Genoa Avenue within the City of Oshawa, from "BR
and R-1B" to "R-1C subject to Special Condition 123" ; from
"BR and R-1B" to "R-2A" ; and from "BR" to "Special Condition
58". The lands which are to be zoned "R-1C Special
Condition 123" shall be implementing a plan of subdivision

consisting of 173 single family dwellings.

The lands being rezoned to "R-2A" will consist of
semi-detached dwellings and the portion being rezoned to
"Special Condition 58" shall be used only for a public park
and such accessory uses. In that regard, this By-law
amendment covers an area of the City of Oshawa which would
have no effect on the interests of the Town and therefore no
further action on this amendment is required. However, the
last date for filing objections was February 2, 1983.

CORPORATION OF THE CITY OF OSHAWA FOR APPROVAL OF A BY-LAW TO E
REGULATE LAND USE PASSED PURSUANT TO SECTION 39 OF THE PLANNING
ACT
TAKE NOTICE that the Council of The Corporation of the City of Oshawa intends to
apply to The Ontario Municipal Board pursuant to the provisions of Section 39 of
The Planning Act for approval of By-law Number 156-82 passed on the 20th day of
December 1982. A copy of the by-law is furnished herewith. A note giving an
explanation of the purpose and effect of the by-law and stating the lands affected
thereby is also furnished herewith.
ANY PERSON INTERESTED MAY within twenty-one (21) days after the date of this
.notice, send by registered mail or deliver to the Clerk of the City of Oshawa
notice of objection to approval of the said by-law or part thereof giving details
of all or the portion of the by-law to which you object and detailed reasons
therefor, and shall indicate that if a hearing is held the objector or an agent
will attend at the hearing to support the objection.
ANY PERSON wishing to support the application for approval of the by-law may
within twenty-one (21) days after the date of this notice send by registered mail
or deliver to the Clerk of the City of Oshawa notice of his support of approval of
the said by-law together with a request for notice of any hearing that may be held
giving the name and address to which such notice should be given.

THE CNI'ARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it
may appoint a time and place when any objection to the by-law will be considered.
Notice of any hearing that may be held will be given only to persons who have

filed an objection or notice of support and who have left with or delivered to the
Clerk undersigned, the address to which notice of hearing is to be sent and
similarly, to any person who has filed a request for a change in the provisions of
the by-law.

being a by-law to further amend By-law Number 3415 of the City of
Oshawa.
BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law
of The Corporation of the City of Oshawa by the Council thereof as
follows:

1. By-law Number 3415 be and the same is hereby further
amended by amending Schedule "A" thereof by adding Special
Condition "123" as set out in Schedule "B" to this By-law.

2. Sheet Number 4 of Appendix "A" to By-law Number 3415, as
amended, is hereby further amended by changing the land use
{
designation for a parcel of land having an area of approximately
17.4 hectares, situated between Thornton Road North and the Oshawa
i
West City Limit, immediately north of Genoa Avenue, as shown on
the revised Sheet Number 4 attached hereto as Schedule "A" from
R-1B and BR, to make the land subject to Special Condition 58 in
part, in part to R-2A and in part to R-lC, subject to the
provisions of Special Condition "123" so that Sheet Number 4 shall
be amended as shown on the revised Sheet Number 4 attached hereto

as Schedule "A".
3, Schedules "A" and "B" attached hereto form part of this
by-law.

4. No part of this by-law shall come into force without the
approval of the Ontario Municipal Board but subject thereto this
by-law shall take effect from the date of its passing.

SPECIAL CONDITION "123"
A parcel of land located between Thornton Road North and the
Oshawa West City Limit, north of Genoa Avenue, as shown on
Schedule "A" hatched and marked R-1C with the figures "123"
encircled shall be subject to the special provisions hereinafter
contained and where there is any conflict between the provisions

hereinafter set out and any other provisions of By-law 3415 and
By-law Number 55-73, these special provisions shall apply, but in
the event that this Special Condition is silent on any matter, the
provisions applicable to an R-1C use district and By-law Number
55-73 shall apply:
1.
Defined Area:
The area subject to this Special Condition is shown on
Schedule "A" hereto, outlined with a heavy line and
hatched with the figures "123" encircled.

2. Regulations:
No person shall on lands affected by Special Condition
11123" use any lot or erect, alter or use any building or {
structure except in accordance with the following
provisions:

2.1 Side Yard Depth
The minimum side yard depth shall be zero,
provided, however, that in no case shall the
distance between the buildings on adjacent lots be
less than 1.8 metres. I�

2.2 Rear Yard Depth
The minimum rear yard depth shall be 7.5 metres,
provided, however, that where a rear yard abuts
Thornton Road Plorth, the rear yard that so abuts
j Thornton Road North shall have a minimum depth of
21 metres.
2. 3 Depth of a Side Yard Abutting a Flanking Street
The minimum depth of a side yard abutting a
flanking street shall be 2.4 metres, provided,
however, that where a side yard abuts Thornton Road
North, the side yard that so abuts Thornton Road
North shall have a minimum depth of 3.6 metres.
2..4 Lot Coverage

The maximum lot coverage shall be 40%.
2.5 Building Height

The maximum building height shall be 10.5 metres.
2.6 Parking Spaces
Each single family dwelling shall have, on the
same lot, a garage containing at least one parking
space.

EXPLANATION OF THE PURPOSE AND EFFECT OF BY-LAW NUMBER 156-82

By-law Number 156-82 changes the land use designation for a parcel
of land, having an area of approximately 17.4 hectares, located
between Thornton Road North and the Oshawa West City Limit,
immediately north of Genoa Avenue, in part from BR and R-1B to
R-1C subject to Special Condition 123, in part from BR and R-1B to

R-2A, and in part from BR to make the lands subject only to
Special Condition 58.

The lands designated R-1C and made subject to Special Condition
123 shall be used for the development of a plan of subdivision
consisting of 173 single family dwellings.
The lands designated R-2A will be developed with adjoining lands
to the north for semi-detached dwellings.
The lands made subject to Special Condition 58 are intended for

use as a park and Special Condition 58 restricts the use to that
of a public park and accessory uses.
