SUBJECT: REZONING APPLICATION Z-A-1-15-4
PAUL AND NANCY GORDON - PART OF LOT 14,
CONCESSION 8, FORMER TOWNSHIP OF DARLINGTON
APPLICATION TO AMEND THE HAYDON HAMLET
DEVELOPMENT PLAN
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
_ Administration Committee recommend to Council the
following:
1 . That Report PD-11-83 be received; and
2. That the attached amendment to By-law 2111 , as
amended, be approved in accordance with
Resolution Number GPA-1183-82; and
3. That the attached amendment to the Haydon
Hamlet Development Plan be approved in
accordance with Resolution Number GPA-1183-82.
BACKGROUND:
On August 13th, 1982, Nancy and Paul Gordon submitted an
application to amend the zoning of Part Lot 14, Concession
8, former Township of Darlington.

The requested By-law amendment would allow the applicants to
create one residential lot.
The subject parcel of land is located within the Hamlet of
Haydon, and the Haydon Hamlet Development Plan designates
the site as an "Area Subject to Development Restrictions".
Generally, only agricultural and farm related uses,
conservation, reforestation, public or private open space
and recreational uses are permitted by this designation.
Therefore, in order to proceed with the development of a
residential lot, an amendment to the Haydon Hamlet
Development Plan would be required.
The standard circulation of the proposed rezoning and the
related amendment produced no major objections.
On October 25th, 1982, the General Purpose and
Administration Committee considered Staff Report PD-175-82.
The Report recommended that an appropriate By-law to rezone
the subject parcel of land and the related amendment to the
Haydon Hamlet Development Plan be forwarded to Council for
approval at such time as Regional Council has considered the
amendment to the Hamlet Plan. The Committee endorsed the
Report 's recommendation with Resolution Number GPA-1183-82.
COMMENTS:
On December 20th, 1982, the Town of Newcastle was advised
that the Planning Committee of Regional Council considered
the amendment to the Haydon Hamlet Development Plan on
December 15th, 1982, and had no comment.

* Therefore, staff are now recommending that the attached
By-law and amendment to the Haydon Hamlet Development Plan
be now forwarded to Council for approval in accordance with
the prior Resolution.

WHEREAS the Council of the Corporation cP the Town of Newcastle deems
it advisable to amend Restricted Area By-law Number 2111, as amended,
of the former Township of Darlington.

NOW, THEREFORE, the Council of the Corpc-ation of the Town of
Newcastle enacts as follows:

1 . Map 9 of Schedule "A" to By-law 2111 , as amended, is hereby
further amended by changing to "SPECIAL PROVISION BY-LAW 81 tom" the

zone designation of lands indicated as "ZONE CHANGE TO SPECIAL i
PROVISION BY-LAW 0 4' on the attached Schedule "X" hereto, and by
changing to "Greenbelt (G) Zone" the zone designation of the lands
indicated as "Zone Change to "Greenbelt (G) Zone" on the attached
Schedule "X" hereto.
2. Section 13 of By-law 2111 , as amended, is hereby further amended

by adding thereto subsection (qq) as follows: ' n

"(gq)Part of Lot 14, Concession 8
Notwithstanding any provisions of this By-law to the contrary,
that portion of Lot 14, designated "SPECIAL PROVISION BY-LAW
82- on the attached Schedule "A" hereto shall be used only
in accordance with the following provisions:
(1) Permitted Uses
(a) one single family dwelling and buildings and
structures accessory thereto.
(2) Zone Provisions
(a) Lot Area (minimum) 5000 square metres
(b) Lot Frontage (minimum) 30.0 metres
(c) Front Yard (minimum) 10.0 metres
(d) Exterior Side Yard (minimum) 10.0 metres
(e) Side Yard (minimum) 2.0 metres
(f) Rear Yard (minimum) 38.0 metres
(9) Gross Floor Area (minimum) 110 square metres
_ (h) Building Height (maximum) 10.0 metres
(i) Landscaped Area (minimum) 30 Per Cent
(j) Setback from Street Centreline 20.0 metres

AMENDMENT NO. 1 TO THE HAMLET F.EVIELOPMENT PLAN FOR THE
HAMLET CF HAYDON
1 . Purpose of Amendment
The purpose of Amendment No. 1 to the Hamlet
Development Plan for the Hamlet of Haydon is to
delete the designatior. of "Area Subject to
Development Restrictions" and by replacing said
designation to permit residential development.
2. Basis of Amendment
This amendment is basEd upon the decision of Council
of the Town of Newcastle to permit the development
of one residential unit pursuant to Section 3.2 of
the approved Haydon Hamlet Development Plan.
3. Actual Amendment
Schedule "1 " to the Hamlet Development Plan for the
Hamlet of Haydon is hereby amended by changing from
"Area Subject to Development Restrictions" to
Residential Infilling, One (1 ) Lot" the designation
of the lands shown as "Change to Residential
Infilling, One (1 ) Lot" on the attached Schedule "A"
hereto.
