REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF JANUARY 3, 1983

SUBJECT: EXTENSION OF DRAFT PLAN APPROVAL 18T-78006
PART OF LOT 25, BROKEN FRONT CONCESSION,
FORMER VILLAGE OF NEWCASTLE
NEWCASTLE SHORELINE PROPERTIES LIMITED
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-3-82 be received ; and
2. That Council adopt the following Resolution :
"The Council of the Town of Newcastle hereby
requests the Minister of Municipal Affairs and
Housing to extend the draft plan approval for
Subdivision 18T-78006 for a further one year
period to April 14, 1984."
3. That the request in 2. above be forwarded to
the Minister of Municipal Affairs and Housing,
and that Douglas J. Plitz of Newcastle
Shoreline Properties Limited be so advised;

4. That Newcastle Shoreline Properties Limited be
advised that failing payment of monies
outstanding pursuant to the terms of the
Subdivision Agreement between the Town. and
Newcastle Shoreline Properties Limited by March
1 , 1983, that said Agreement shall be subject
to renegotiation.
BACKGROUND AND COMMENTS:
A copy of the attached letter was received by the Planning
and Development Department on November 24, 1982. The letter
from Douglas J. Plitz, on behalf of Newcatle Shoreline
Properties Limited, requests that the draft plan of the
above-mentioned plan be extended.
In reviewing this request staff note that the draft approval
of this plan of subdivision expires on April 14, 1983. The
reason for the request in extension of draft approval is due
to the fact that the subdividers are unable to proceed with
this subdivision at the present time. We note that the
required subdivision agreement has been conditionally
approved by the Town and upon execution of same registration
of this Plan could proceed. Staff would therefore have no
objection to the approval of a further one year extension in
draft plan approval of 18T-78006. Prior to the expiry of
draft plan approval in 1984, the plan would again be
reviewed.
However, we would also suggest that in view of recent
negotiations, in respect of other development proposals
south of Highway 401 which require access via Mill Street ,
that should this development not be proceeded with

with expeditiously that the development agreement between
the Town and Newcastle Shoreline Properties be reviewed and
updated as necessary. However, since this is a relatively
new agreement, we would suggest that this only be done if
the Onwers have failed to pay to the Town by March 1 , 1983
those monies required upon execution. In that regard, staff
note that although the agreement was approved for execution
on March 1 , 1982, it has not been executed on behalf of the
Town inasmuch as these monies have not yet been paid by the
Owner. These monies include cash in lieu of parkland, lot
levies , occupancy deposits , developer's share of road
reconstruction costs, and administrative charges. This
amounts to cash payments of $40,767.71 and letters of credit
totalling $16,100.
