THAI Report PD-200-86 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and Administration Committee, Staff have * prepared the attached list of applications to the Committee of Adjustment for the meeting of July 16, 1986. Murdoch APPLICATIONS: A 27/86 - Wray and Sandy Rendell , Lot 28, Concession 5, Clarke Application was made for relief from zoning by-law requirements in order to permit the applicant to erect a 5 ft. high fence encroaching into the site triangle along Cobbledick St. a distance of 10 ft. Mrs. Rendell appeared in support of this application. A letter of objection was received from Mr. Lycett on behalf of Mrs. Irwin as well as an objection from the Works Department. No other person appeared in support of or in objection to this application. Moved by Mr. Barrie, seconded by Mrs. Payne, "THAT the Committee feel that the erection of a 5 ft. high fence, which would encroach a distance of 10 feet into the site triangle, would not be prudent or safe from a vehicular traffic view, and for these reasons the application to encroach 10 ft. into the side triangle is DENIED. However, the Committee and the Works Department agree to a lesser encroachment of 5 feet into the site triangle. " "CARRIED" 'Reicheld Opposed' Committee of Adjustment Meeting, July 16, 1986. . . . . A 28/86 - Lorne Dechene, Lot 17, Concession 5, Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to expand a legal non-conforming single family dwelling. Neil Henderson appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne, seconded by Mr. Rehder, "THAT as the variance appears to conform with the intent of the Zoning By-law and Official Plan and would not appear to have a detrimental effect on the surrounding properties, permission if GRANTED to expand a legal non-conforring single family dwelling. This approval is conditional upon meeting the requirements of C.L.O.C.A. " "CARRIED" A 29/86 - David & Eva Shmyr, Lot 17, Concession 5, Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a 572 sn_ ft. acreggo y building which would exceed the maximum requirement of not more than 40% of the main building total floor area. Mr Shmyr appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Barrie, seconded by Mr. Reicheld, THAT as the requested variance would not appear to offend the intent of the Official Plan and Zoning By- law or have a detrimental effect on the surrounding neighbourhood and as the requested 572 sq. ft. garage is accessory to the residential use, the application is considered minor and therefore is GRANTED." Moved by Mrs. Payne, seconded by Mr. Riecheld, "THAT as the requested variance is in keeping with the intent of the Zoning By-law and Official Plan and as the proposed 660 sq. ft. garage is considered accessory to the principle residential use, this application is minor in nature and is therefore GRANTED.
