HomeMy WebLinkAboutPD-204-86 TOWN OF NEWCASTLE REPORT File Res. # r= _ By-Law # MEETING: General Purpose and Administration Committee DATE: Tuesday, September 2, 1986 REPORT #: PD-204-86 FILE #: 18T-79038 SUBJECT: EXEMPTION FROM PART LOT CONTROL PLAN OF SUBDIVISION - 18T-79038, PLAN IOM-781 JOHN FOLEY PART LOT 35, CONCESSION 2, DARLINGTON RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-204-86 be received; and 2. THAT the request submitted by Mr. Mark Foley thereby exempting Lots 28 to 37 (inclusive) , 45, 46, 47 and, 57 to 64 (inclusive) on Plan 1OM-781 from Part Lot Control be acknowledged; and 3. THAT the attached by-law be approved and forwarded to the Regional Municipality of Durham pursuant to Section 49, Subsection (7 ) of the Planning Act; and 4. THAT Mr. Mark Foley be so advised. BACKGROUND AND COMMENT: On August 1, 1986, Staff received a request from Mr. Mark Foley for an exemption from Part Lot Control in respect of Lots 28 to 37, 45, 46, 47, and 57 to 64 in registered Plan of Subdivision IOM-781. . . .2 REPORT NO.: PD-204-86 Page 2 Staff have reviewed the request and would have no objection to same and the approval of the by-law exempting the subject lands within this Plan from Part * Lot Control . In that regard, attached hereto is a by-law which requires approval of Council and the Regional Municipality of Durham which would exempt the subject lands from Section 49(5) of the Planning Act pursuant to the provisions of Section 49(7) of said Act. Accordingly and in order to facilitate conveyance of title of the individual semi-detached dwellings located on these lots, it would be appropriate for the Council to approve the necessary exemption from Part Lot Control . LAND DEVELOPMENT • CONSTRUCTION • PROPERTY SALES AND MANAGEMENT THE CORPORATI ON OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 86- being a By-law to designate a certain portion of a Registered Plan as not being subject to Part Lot Control. WHEREAS the Council of the Town of Newcastle deems it desirable to exempt, from Part Lot Control , Lots 28 - 37; 45, 46, 47; 57 - 64 (inclusive); of Plan 1OM-781, registered at the Land Registry Office for the Land Registry Division of Newcastle (No. 10) on August 1, 1986; NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. That Subsection (5) of Section 49 of the Planning Act shall not apply to those lands described in Schedule "A" to this by-law. 2. This by-law shall come into effect upon being approved by the Regional Municipality of Durham, and thereafter Subsection (5) of Section 49 shall cease to apply to the lands described in Schedule "A" hereto. 3. Schedule "A" attached hereto shall form part of this by-law. BY-LAW read a first time this day of 1986.
