By-Law # MEETING: General Purpose and Administration Committee DATE: Tuesday, September 2, 1986 REPORT #: PD-206-86 FILE #: Pln. 7.2 SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT APPLICATIONS FOR THE MEETING OF AUGUST 6, 1986 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PO-206-86 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and Administration Committee, Staff have * prepared the attached list of applications to the Committee of Adjustment for the meeting of August 6, 1986. This list includes the file number, applicant' s name, site location , type of variance requested, Official Plan Conformity, By-law Conformity, Staff' s comments on the applications and the Committee of Adjustment' s decision. Murdoch APPLICATIONS: A 40/86 - Susan Vaughan, Lot 20, Concession 10, Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to create a lot maintaining the existing 80 ft. (24.38 m) frontage on a maintained road. Mrs. Vaughan appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Reicheld, seconded by Mr. Rehder, "THAT as the requested variance would not appear to offend the intent of the Zoning By-law or Official Plan or have an adverse effect on the surrounding properties and as the variance is recognizing an existing situation and is considered minor in nature, permission is GRANTED to create a lot maintaining an 80 ft. Concession Bowmanville Application was made for relief from zoning by-law requirements in order to permit the applicant to create a lot with an area of 1525 sq. m, instead of the required 2800 sq. m and maintaining an existing 18.53 m frontage, instead of the required 30 m frontage. M. B. Kelly and Mr. Rowley appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne, seconded by Mr. Barrie, "THAT as the requested variance would be keeping within the intent of the Official Plan and Zoning By-law and as the severed portion is to meld with the abutting property, the variance is considered minor in nature and permission is GRANTED to create a lot with an area of 1525 sq. m and maintaining an existing 18.53 m frontage. Mr. & Mrs. Allin appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne, seconded by Mr. Heming, "THAT as the variance would not offend the intent of the Official Plan or Zoning By-law and as the proposed building is considered accessory to the residential use, the variance is considered minor in nature and permission is GRANTED to construct a 528 sq. ft. accessory building. "CARRIED" A 47/86 - Dr. John & Patricia Rundle, Lot 12, Conc. 1 , Bowmanville. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct an addition to an existing single f ami lly dwelling maintaining rexisting (3. 11 _) moot yard, instead of the required 6.0 m front yard and an interior side yard of 13.9 feet (4.24 m) , instead of the required 4.5 m side yard where there is no attached garage or carport. Dr. and Mrs. Rundle appeared in support of this application. No other person appeared in support of or in opposition to this application. "CARRIED" Committee of Adjustment Meeting, August 6, 1986. . . . . . . . A 48/86 - Francis & Erla Jose, Lot 26, B.F.Conc. , Newcastle Village. Application was made for relief from zoning by-law requirements in order to permit the applicant to create a lot with a frontage of 26 m on a maintained road, instead of the required 30 m frontage. Mr. & Mrs. Jose appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne, seconded by Mr. Barrie, "THAT as the requested variance appears to conform with the intent of the Official Plan and Zoning By- law and would not have an adverse effect on the surrounding properties and the retirement lot appears to be in a desireable location with re- spect of the agricultural use and the surrounding residences, therefore permission is GRANTED to create a lot with a frontage of 26 m on a main- tained road.
