At the June 2nd, 2003 General Purpose and Administration Committee, Staff presented Report PSD-061-03, recommending closure of inactive applications for Official Plan Amendments, Zoning By-law Amendments and Plans of Subdivision (See Attachment #1). 1.2 Three delegations appeared before Committee to request number of files remain open. Ms. Libby Racansky also appeared, requesting applications in the north Courtice area be included in the report. 1.3 Committee endorsed the recommendations contained in PSD- 061-03 save and except, for application DEV 99-022, wherein Council granted a six month extension. Committee referred applications 18T 85025, 18T 86068, and 18T 88057 & Dev 90-011 back to Staff for the preparation of a subsequent report regarding the status of the each file. 2.0 Plan of Subdivision 18T 85025. Wallis and Colboott 2.1 Mr. Glenn Genge of DG Biddle & Associates appeared on behalf of Leon Wallis and Danuta Colboott (18T-85025) and requested that file not be refused and closed. The development of the site had been pending the realignment of Bloor Street and the installation of a stormwater management facility south of the subject site. Mr .Genge indicated that the realignment of Bloor Street has been resolved and the stormwater management pond has been constructed. His client is now in a position to seek draft approval. Edward Wallis also requested the file remain open. 2.2 Application 18T 85025 was submitted to the Region of Durham in 1985 for 61 residential units (see Attachment 2). Revisions were received in April 1989, and March 1992. In 1993, Staff advised the applicant that a number of studies were required in order to consider draft approval including a Neighbourhood Plan, Servicing Report, Stormwater Management Report and a Traffic Report. As part of the consideration for adding new residential lands during the last Official Plan Review, the subject lands were included in the South West Courtice Secondary Plan. , REPORT NO.: ADDENDUM PSD-061-03 PAGE 3 The storrnwater management plan for this area was completed in 1996. This allowed for draft approval of Robinson Ridge (18T-89037), 289143 Ontario Ltd. (18T-95023), and 765400 Ontario Limited (18T-95026) by the Ontario Municipal Board on September 20, 1996. There is no requirement for the storrnwater pond to be built or to have completed the maintenance period prior to draft approval. A Neighbourhood Plan was prepared by other developers and approved in 1996, which fixed the alignment of Bloor Street. The alignment was subsequently incorporated into the Clarington Official Plan in 1996. The realignment of Bloor Street occurs with the "Huntington" plan of subdivision submitted by 765400 Ontario Ltd. approved in September 20, 1996 and currently under construction. 2.3 Staff Comments The applicant has not submitted any documentation to support the applications. Only upon the receipt of the notice to close the application did the applicant contact with the Municipality to pursue the development of the site. Application 18T-85025 could have proceeded with seeking draft approval in 1996 with all of the other developments in south-west Courtice. As such, Staff's recommendations contained in stand. 3.0 Plan of Subdivision 18T 86068. Schleiss and Holland 3.1 Mr. Genge also represented Mr. Walter Schleiss. He noted that the application has been unable to proceed pending review of environmental issues and resolution of Adelaide Avenue extension. 3.2 Application 18T 86068 was submitted to the Region of Durham in 1986 (see Attachment 3). It was submitted concurrently with an application to amend the Neighbourhood Plan to remove the "Minor Open Space" designation from a woodlot to permit it to be developed for residential purposes. In March 1988, 13 lots were draft approved. The ,~ REPORT NO.: ADDENDUM PSD-061-03 PAGE 4 balance of the application was pending a study to determine the impacts on a woodlot situated on the subject property. No such study was received. The adoption of the Municipality of Clarington Official Plan in 1996 designated the site as Environmental Protection Area in consideration of a woodlot and wetland. 3.3 With respect to the issue of Adelaide Avenue, in 1989 Council passed a resolution to make no decision on plans of subdivision within Neighbourhood 3 of the Courtice Urban Area (under the former Official Plan) until a Needs and Route Alignment Study was undertaken for the Adelaide Avenue extension. The Schleiss & Holland subdivision was located in Neighbourhood 1 and was therefore not subject to any freeze on approvals. 3.4 Through Report PD-55-96, (April 29, 1996) Council requested the Region of Durham to refuse and close the application because it does not conform to the Clarington Official Plan. The Region, as an oversight did not close the file. As such, Staff's recommendations to refuse and close at this time are consistent with Council's previous . resolution. 4.0 Plan of Subdivision 18T 88057 & Dev 99-011 Kinasberrv Properties 4.1 Mr. Genge also represented Mr. H. Halminen (18T-88057 and DEV 90-011). Mr. Halminen has an offer of purchase and sale pending on the lands subject to 18T-88057 and DEV 90-011. Mr Genge noted that the applications have not been able to proceed due to the uncertain location of the Adelaide Avenue extension. Mr. Genge noted that the Environmental Assessment for the Adelaide Avenue extension will be underway shortly. His clients will seek draft approval once the EA is complete. Mr. Genge requested that both files not be refused and closed. 4.2 Application 18T 88057 ( See Attachment #4) was submitted to the Region of Durham in 1988. Application Dev 90-011 was submitted to the Municipality of Clarington in 1990. The subject site is located in an environmentally sensitive area. In 1996 the applicant was advised that an Environmental Impact Study (EIS) was required as well as a Neighbourhood Development Plan. An EIS has not been submitted. A Neighbourhood REPORT NO.: ADDENDUM PSD-061-03 PAGE 5 Development Plan for the Glenview neighbourhood was adopted in 1999, the site was identified as an area subject to future review/study. 4.3 Staff Comments Staff have confirmed with the Region of Durham Works Department the Environmental Assessment (EA) for Adelaide Avenue extension will proceed this year and will be completed later 2004/2005. The draft Durham Mobility Study recommends that Adelaide Avenue be extended to Trulls Road, however the Durham Region Official Plan shows it extending to Courtice Road. The Region of Durham is preparing Terms of Reference to retain a consultant to prepare the EA to justify the need of Adelaide Avenue and how far east it will go. If it is determined that the extension not proceed beyond Trulls Road then an Official Plan amendment will be required to remove Adelaide Ave extension between Trulls Road and Courtice Road. The subject is site is also within Special Study Area #5, and designated as Environmental Protection Area associated with the Blackcreek Provincially Significant Wetland, as such an Environmental Impact Study will be required, as well as an Storm Water Management Report and a Noise Impact study. None of these studies have been submitted to date. The resolution of the Adelaide Avenue extension still requires study that will take several years. Notwithstanding the indication that the lands are subject to a sales agreement, Staff assert that the file should be closed and the new owner should resubmit a new application. As such Staff's recommendations contained in PSD-061-03 still stand. 5.0 Submitting New Applications for Plans of Subdivision 5.1 The three applications discussed above were submitted fifteen years or more ago. There has been very little activity on these files in the last 5 years or more. If Council endorses Staff's recommendations to close these files without prejudice the applicant may choose to submit a new application for Plan of Subdivision. A number of changes have occurred in the processing of subdivision applications since these files were submitted. First, the Region of Durham has delegated the approval of subdivisions to areas municipalities. Any new development interests will be required to submit applications to the Municipality of Clarington with the appropriate fees. The appropriate studies would be required at the time the applications are submitted. Secondly, the new REPORT NO.: ADDENDUM PSD-061-03 PAGE 6 applications will be processed under the current Planning Act, which requires public meetings to be held prior to draft plan approval. 6.0 RECOMMENDATIONS 6.1 These files are being recommended for refusal due to lack of activity or interest on the part of the applicants to proceed expeditiously. This decision will not prejudice a decision on a new application. It is respectfully recommended that Council approve the recommendations contained in this Addendum report to refuse and close, without prejudice applications 18T-85025, 18T 86068 and 18T 88057 & Dev 90-011. REPORT NO.: PSD-061-03 PAGE 2 1.0 BACKGROUND 1.1 The Planning Services Department currently has a number of outstanding files for various types of development applications. There include: ~ An application to amend the Clarington Official Plan; ~ Applications to amend the Comprehensive Zoning By-law 84-63; and ~ Applications for Plan of Subdivision. 1.2 The applications have been inactive for a number of years, either because the applicant has not submitted the required technical studies~ to support the application, additional development applications were required and have not been filed or the lands have changed ownership and the new owner has chosen to proceed with a different development application. 1.3 All of these applications have had a Public Meeting and Council recommended that they be referred back to Staff for further processing. The purpose of this report is to deal - with Council's previous direction on each a!1Plication and recommend that the files be closed. 2.0 COMMENTS 2.1 Appendices No.1, 2 and 3 to this Report lists the outstanding applications for Official Plan amendment, Zoning by-law amendment and draft approval of Plans of Subdivision respectively. Staff's comments and recommendations are provided for the application. 2.2 Attachments 1-12 contain the location map and interested parties list for each application. 2.3. In the instance, where the applicant has not submitted the requested information or filed the appropriate development application, Staff had contacted the applicant and requested that they advise staff of their intentions to proceed with the application. A considerable time has passed since that time and therefore Staff are recommending that these files be closed.
