RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-230-86 be received; and
• THAT Stdff Report PD-182-86 be lifted from the tab le and received for information;
and
3. THAT the Region of Durham be advised that the Town of Newcastle recommends that
Official Plan Amendment Application 86-II/D and proposed Plan of Subdivision
18T-86009 be denied; and
4. THAT a copy of Council 's decision be forwarded to the Region of Durham and the
applicant.
BACKGROUND:
On July 21, 1986, the General Purpose and Administration Committee considered Staff Report
PD-182-86 which dealt with the applications to amend the Regional Official Plan and for

Plan of Subdivision submitted by Joseph and Carl Schwarz to permit the
development of twenty-three (23) estate residential lots in Part Lot 22,
* Concession 2, former Township of Darlington (see Key Map attached).
The Report presented comments from agencies circulated with the
applications. In particular, the Region of Durham Health Unit noted the
presence of a high water table in the area and the questionable percolation
rates of the soil . The Health Unit advised that further comments would be
provided once a more detailed examination of the site had been conducted
with the applicant's Soil Consultant.
The Ministry of Agriculture and Food states that the soils on-site have an
agricultural capability rating of Class 1, and that agricultural lands lie
to the south and the east of the subject site. The Ministry indicated that
the subject proposal does not comply with the Foodland Guidelines.
Staff also noted in the Report that the subject site is primarily bush or
scenic scrub ldrid, and not located in a well-vegetated area of roiling
topography as required by the Regional Official Plan. Based on these
considerations, Staff recommended that the subject applications be denied.
The applicant appeared as a delegation at the July 21, 1986 Committee
meeting to request that his applications be tabled to allow further
discussion with the Ministry of Agriculture and Food. Committee resolved
(Resolution #GPA-698-86) to table the applications until the September 15,
1986 Committee meeting. At this latter meeting, the applicant submitted a
letter from the Ministry of Agriculture and Food stating that the
agricultural capability of the subject lands is lower than first indicated
and that the Ministry would no longer be pursuing its initial concerns with
this proposal . Committee resolved to receive the letter for information.

The following comments from the Region of Durham Health Unit with respect to
the proposed development were received on July 17, 1986:
"The above property was inspected with the owner on July 10, 1986. The
Health Department does not recommend approval of the Subdivision or the
Official Plan Amendment, due to the high ground water table.
The water table fluctuates with the seasons and would be within one foot of
the surface for much of the year. This high water table would result in
tile beds being raised up to four feet above grade with granular fill and
sewage would most likely be pumped up to the tile bed. The end result
being, individual lot owners would be responsible for the cost of these
expensive sewage disposal systems.
In the eastern area of this property, there is sandy soil along with the
high water table, which could result in contamination of the water table."
By letter dated July 21, 1986 (attached) the Region of Durham Planning
Department advised the applicant that, unless the concerns of the Health
Department would be unable to consider approval of the proposed development.
COMMENT:
Notwithstanding the revised comments from the Ministry of Agriculture and
Food, Staff continue to be of the opinion that the proposed development does
not comply with the criteria as outlined by the Regional Official Plan,
noting the presence of agricultural operations to the south and east of the
subject lands. Staff also reference the comments from the Region of Durham
Health Unit with respect to the suitability of the lands for private sewage
disposal .
Based on the above considerations, it is recommended that the Region of
Durham be advised that the Town of Newcastle recommends that Official Plan
Amendment Application 86-11/D and Proposed Plan of Subdivision 18T-86009 be
denied.

Please find enclosed a copy of the comments from the Department
of Health Services for-the Region of Durham. The letter is
self-explanatory and it appears that the soil and water table
conditions in this area are not conducive to development. Unless
the concerns of the Health Department can be rectified, we
regret to advise you that we cannot consider your plan of subdivision
for draft approval .
We will present a report to the Planning Committee and Council
in due course and will advise you accordingly.
