SUBJECT: PROVINCIAL GOVERNMENT FLOODPLAIN CRITERIA
SPECIAL POLICY AREAS
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-236-86 be received; and
2. THAT Council resolves to request the Central Lake Ontario Conservation Authority to
adopt a "Special Policy Area Statement" for the watersheds of the creeks identified
by Staff Report PD-236-86 so that the regulatory flood is reduced to reflect the
1: 100 year storm; and
3. THAT Council further resolves that any necessary studies to establish the flood
line for such reduced regulatory flood should be at the expense of the development
proponents except where funding may be available from senior levels of government;
and
4. THAT a copy of Staff Report PD-236-86 and Council 's resolution be forwarded to the
Central Lake Ontario Conservation Authority.

BACKGROUND:
The Provincial Government's Policy Statement on Floodplain Criteria, which
was released jointly by the Ministries of Natural Resources and Municipal
Affairs and Housing in September, 1982, outlines a number of floodplain
criteria and policies to be used as the basis for implementing floodplain
management in the Province.
Policy Number 1 in the Policy Statement defines the greater of the Regional
Storm Flood or the One Hundred Year Storm Flood as the Regulatory Flood.
The Regulatory Flood is the flood against which protection is to be provided
and upon which floodplain delineations are to be based.
Policy Number 3 in the Policy Statement notes that in certain circumstances,
however, the strict application of Floodplain Regulations may not be
feasible. Such a situation would occur where a substantial proportion of
the commercial , retail , industrial or residential development in a community
it located in the floodplain. and the rehabilitation, redevelopment or
replacement of structures within the floodplain is considered essential to
the continued viability of the community. In exceptional circumstances such
as this, a Municipality may request the designation of the built-up area in
the floodplain as a Special Policy Area. Within a Special Policy Area, a
higher than normal degree of flood risk is accepted, and the Conservation
Authority uses a lower standard of protection when considering applications
for construction or the placing of fill .
In February, 1983, the Central Lake Ontario Conservation Authority requested
the Town of Newcastle to define any areas within our boundaries which we
consider would warrant special recognition under Policy Number 3. Within
its watershed, C.L.O.C.A. generally uses the Regional Storm Flood as the
Regulatory Flood.

Staff reviewed the floodplain mapping for all of the urban areas and hamlets
within the Town and, in Staff Report PD-77-83 which was considered by
Committee at its meeting of May 16, 1983, noted that there is very little
urban type development within floodplain lands, and none which warrants
special attention. Staff recommended that C.L.O.C.A. be advised that no
areas within the Town of Newcastle would, in the Town's opinion, qualify for
Special Policy Area Status. Committee adopted the recommendation in the
Staff Report, which was subsequently endorsed by Council .
COMMENT:
As the result of increasing development pressures on lands located within
the Regional Storm floodplain in the vicinity of Highway 401 in and around
the Bowmanville Urban Area, Staff have recently reviewed the possibility of
designating the watersheds of a number of creeks as Special Policy Areas
where the regulatory flood would reflect the 100 year storm. The creeks
* examined by Staff, as shown by Attachment No. 1, are as follows:
- Darlington Creek and Westside Creek watersheds north of the
Canadian National Railway to Baseline Road. This would include
lands to the north and south of Highway No. 401 which are
designated "Industrial" in the Official Plan.
- Bowmanville Creek watershed north of Highway No. 401 to a point
some 375 metres north of Baseline Road. This would increase the
area available for development for lands designated "Commercial "
and "Residential " in the Official Plan.
- Soper Creek watershed north of Highway No. 401 to a point some
175 metres north of Baseline Road. This would include lands
adjacent to Industrially-designated lands south of Baseline Road,
and an existing apartment building located north of Baseline
Road.

Given the Official Plan designations for these areas and the unique
constraints created by man-made structures which greatly increase the extent
of floodplains, Staff feel that special consideration should be given to
reducing the regulatory flood to reflect the 1: 100 year storm. C.L.O.C.A.
Staff have advised that development permitted by the reduced Regulatory
Flood will be required to incorporate special flood-proofing measures and
will still be subject to the Authority' s Fill and Construction Regulations.
Staff recognize that studies will be required to establish the flood line
for such reduced regulatory flood, and suggest that such studies should be
at the expense of development proponents except where funding may be
available from senior levels of government.
It is therefore recommended that Council resolve to request the Central Lake
Ontario Conservation Authority to adopt a "Special Policy Area Statement"
for the indicated watersheds to reduce the Regulatory Flood to reflect the
1: 100 year storm, and that any necessary studies to establish the reduced
regulatory flood line should be at the expense of development proponents
except where funding from senior levels of government may be available.
