By-Law # I MEETING: General Purpose and Administration Committee DATE: Monday, October 20, 1986 REPORT #: PD-251-86 FILE #: DEV 86-49 SUBJECT: REZONING AND SITE PLAN APPLICATIONS ANN PSILOPOULOS PART LOT 25, CONCESSION 2, FORMER TWP. OF DARLINGTON OUR FILE: DEV 86-49 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-251-86 be received; and 2. THAT the application submitted by Mrs. Ann Psilopoulos to rezone a 1.63 hectare parcel of land located in Part of Lot 25, Concession 2, former Township of Darlington , to permit the development of a motor vehicle sales establishment in addition to the existing motor vehicle repair garage be recommended for approval and the by-law forwarded to Council , at such time as a Site Plan Control Agreement has been entered into between the Owner and the Town of Newcastle. BACKGROUND AND COMMENT: On July 16, 1986, the Planning Department received an application for rezoning and site plan approval from Mrs. Ann Psilopoulos to permit the development of a motor vehicle sales establishment. This would be in addition to the existing use which is a repair garage. . . .2 REPORT NO.: PD-251-86 Page 2 Staff would note for the Committee's information that pursuant to Council 's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. Staff would note that no objections to the proposal were received at the writing of this Report with respect to the amendment requested. In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. Staff would note the following departments/agencies, in providing comments, offered no objections to the application as filed: - Newcastle Community Services Department - Newcastle Building Department - Central Lake Ontario Conservation Authority - Ministry of Agriculture and Food The subject property is found in the "Major Open Space" designation of the Durham Region Official Plan. The establishment of such a use would not generally be permitted but this is an expansion to an existing repair garage and may be permitted by Section 16.6.5. This section allows municipal Councils the discretion to permit the enlargement or variation to similar uses. Staff is of the opinion that this proposal falls within this guideline. The Newcastle Fire Department was concerned with the maintaining of clear access to the two existing dwellings on the site. This concern has been noted and Staff will ensure that the access will be provided before the Site Plan is finalized. The Regional Health Services Department have raised a concern with respect to the location of the existing tile bed for the "garage". Prior to providing their approval , this tile bed must be relocated to their . . .3 (0) REPORT NO. : PD-251-86 Page 3 satisfaction. An application for this relocation must be filed with the Health Services Department. The new location must be determined prior to the Site Plan being approved due to the fact that the tile bed is currently located under the parking area. This area is to be paved as a part of the Site Plan approval and the Site Plan will be required to show the new location of the tile bed. The Ministry of Transportation and Communications has provided verbal comments and this agency voiced concern over the proposed grading and access onto Highway No. 2. The highway is to be reconstructed in the near future and part of this will include grading changes and alterations to the access to this site. The Ministry has been requested to submit a draft of the proposed changes. When this has been received the Site Plan can be updated to reflect the needed changes to access and grading. Accordingly, Staff, in consideration of the above, would have no objections to the approval in principle of the application and Staff would recommend * that the attached By-law be forwarded to Council to permit this development only after a Site Plan Control Agreement has been entered into between the Owner and the Town of Newcastle. October 9, 1986 CC: Mrs. Ann Psilopoulos R.R. #5 BOWMANVILLE , Ontario L1C 3K7 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 86- being a By-law to amend By-law 84-63, Comprehensive Zoning By-law of the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFOkE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 21.4 of By-law 84-63 is hereby amended by adding the following new Subsection 21.4.8: "21.4.8 SERVICE STATION COMMERCIAL EXCEPTION (C6-8) ZONE Notwithstanding Section 21.1, those lands zoned "C6-8" on the Schedules to this By-law may, in addition to and as the ancillary to uses permitted in the C6 Zone, be used for the sale of motor vehicles subject to the following zone regulations: a) Number of cars to be displayed for sale at one time (maximum) 20 b) Notwithstanding the uses permitted in conjunction with a "Motor Vehicle Sales Establishment" as defined herein, the use of these lands and the buildings located thereon for a motor vehicle body shop as defined herein is specifically prohibited. 2. Schedule 1 to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Service Station Commercial (C6)" to "Service Station Commercial Exception (C6-8)" zone, as shown on the attached Schedule "X" hereto. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act, 1983, BY-LAW read a first time this day of 1986 BY-LAW read a second time this day of 1986 BY-LAW read a third time and finally passed this day of 1986.
