SUBJECT: REZONING AND SITE PLAN APPLICATIONS

RECOMMENDATIONS:
It is respectfully recommended ,that the General Purpose and Administration Committee
recommend to Council the following:
I. THAT Report PD-252-86 be received; and
2. THAT the application submitted by Mr. R. Bruynson on behalf of Mr. John Rice to
rezone a 0.58 hectare parcel of land located in Part of Lot 12, Concession 1,
former Town of Bowmanvi 1 le, to permit the development of a seventy-seven (77 ) unit
condominium be referred back to Staff pending completion of the outstanding
studies.
BACKGROUND AND COMMENT:
On August 20, 1986, the Planning Department received an application from Mr. R. Bruynson
on behalf of Mr. John Rice to permit the development of a seventy-seven (77) unit
condominium apartment building.
The Bowmanville Urban Area Plan requires a number of studies to be completed. These
studies are especially critical when examining a proposal of this scale. In the past,
servicing for this site had been an issue. From verbal comments from the Region, the

capacity apparently exists for this site. It also must be determined
whether the increase in scale on this site will adversely impact the
development potential of other sites in the drainage area. The other Study
required by this plan is a Noise and Vibration Study. This site is
relatively close to the Canadian Pacific track, therefore, the impact and
attenuation measures must be examined. This Study must be completed and the
Ministry of Environment will have to comment upon the Study.
Staff would note for the Committee' s information that pursuant to Council ' s
resolution of July 26, 1982 and the requirements of the Planning Act, the
appropriate signage acknowledging the application was installed on the
subject lands.
In accordance with departmental procedures, the application was circulated
to obtain comments from other departments and agencies as noted within Staff
Report PD-167-86. At this time there are a number of comments which are
outstanding. Staff wishes to have responses from a number of these agencies
before coming forward with a recommendation.
At this time the following are the only responses the Planning Department
has received.
Newcastle Community Services Department has requested that 5% cash-in-lieu
of parkland be paid.
The Town's Building Department and the Regional Health Department have no
objections to the proposal .
The Newcastle Fire Department has raised concerns regarding the access to
the main entrance from Scugog Street, the parking areas for emergency
vehicles, and the lack of turn around facilities in the parking area
accessed from Wellington Street. These concerns can be addressed through
minor changes to the site concept.

In addition, Staff are concerned with the potential impact of a structure of
this bulk and massing upon this site, neighbouring sites and the development
potential of the entire area. Until all of the impact studies have been
completed, Staff is not in a position to present a recommendation to
Council .
At such time as all required studies and comments have been received, a
further report will be submitted.
