THAT Report PD-258-86 be received; and 2. THAT the request submitted by Mr. George Smith, on behalf of Kiddicorp Investments, thereby exempting Lots 44 to 58 (inclusive) , on Plan 1OM-784 from Part Lot Control be acknowledged; and 3. THAT the attached by-law be approved and forwarded to the Regional Municipality of Durham pursuant to Section 49, Subsection (7) of the Planning Act; and 4. THAT Mr. George L. Smith be so advised. BACKGROUND AND CONIVENT: On October 20, 1986, Staff received a request from Mr. George L. Smith for an exemption from Part Lot Control in respect of Lots 44 to 58 (inclusive) in registered Plan of Subdivision 1OM-784. . . .2 (C) REPORT NO.: PD-258-86 Page 2 Staff would note for the Committee' s information that, pursuant to a previous request, a resolution of Council was considered and adopted, at Council 's meeting of June 9, 1986, to the effect that the Town of Newcastle had no objections to the proposed revisions to Lots 44 through 58 inclusive, to permit the development of link homes. The request, as submitted by Mr. George L. Smith, is to implement this condition of draft approval . Staff, accordingly, have reviewed the request and would have no objection to same and the approval of the by-'law exempting the subject lands within this * Plan from Part Lot Control . In that regard, attached hereto is a by-law which requires approval of Council and the Regional Municipality of Durham which would exempt the subject lands from Section 49(5) of the Planning Act pursuant to the provisions of Section 49(7) of said Act. Accordingly and in order to facilitate conveyance of title of the individual semi-detached dwellings located on these lots, it would be appropriate for the Council to approve the necessary exemption from Part Lot Control . My client has entered into (-agreements of Purchase and Sale which transactions are scheduled to start closing on or about November- �:-O, 1986. In order- to convey these Lots, we require a By-Law to be registered on title deeming Part Lot Control not to affect certain Lots. The Lots which are building semi-detached dwellings and require the deeming By-Law to be registered are Lots 44 to v8 inclusive on registered Plan 1OM-784. I would ask that you kindly attend to obtaining and registering this By-Law at your earliest opportunity. Thank you for your attention to this matter. LOB 1 NO - (416) 985-8465 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 86- being a by-law to designate a certain portion of a Registered Plan as not being subject to Part Lot Control. WHEREAS the Council of the Town of Newcastle deems it desirable to exempt, from Part Lot Control , Lots 44 - 58 (inclusive); of Plan IOM-784, registered at the Land Registry Office for the Land Registry Division of Newcastle (No. 10) on October 3rd, 1986; NOW THEkEFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. That Subsection (5) of Section 49 of the Planning Act shall not apply to those lands described in Schedule "A" to this by-law. 2. This by-law shall come into effect upon being approved by the kegional Municipality of Durham, and thereafter Subsection (5) of Section 49 shall cease to apply to the lands described in Schedule "A" hereto. 3. Schedule "A" attached hereto shall form part of this by-law. BY-LAW read a first time this day of 1986.
