SUBJECT: AMENDMENT TO BY-LAW 84-63
PART LOTS 7 to 10, CONCESSION 5, DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended' that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-264-86 be received; and
* 2. THAT the by-law attached to this Report to rezone Part Lots 7 to 10, Concession 5,
former Township of Darlington from "Agricultural (A-1 )" to "Agricultural (A)" be
forwarded to Council for approval .
BACKGROUND AND COMMENT:
On September 2, 1986, Committee considered Staff Report PD-197-86 which dealt with
Official Plan Amendment application 85-50/D submitted by Blair and Elspeth McMullan to
permit the establishment of a commercial kennel in Part Lot 9, Concession 5, Darlington.
The Report recommended that the Region be advised that the Town reaffirms its
recommendation that the site specific application be denied. The Report further
recommended that the Region review the "Permanent Agricultural Reserve" designation for
the area, and in consideration of the fragmented land ownership, that the designation be
amended to "General Agricultural Area". Committee resolved (Resolution #GPA-769-86) to

adopt the recommendations in the Report. Committee' s decision was
subsequently endorsed by Council on September 8, 1986.
Regional and Town Planning Staff discussed the appropriate boundaries for
the area to be redesignated on the basis of land use and property
fragmentation. Regional Staff forwarded a report to the October 14, 1986
meeting of the Regional Planning Committee recommending that the Regional
Plan be amended to redesignate portions of Lots 7 to 10, Concession 5,
Darlington to "General Agriculture Area". The amendment was approved as
Amendment No. 156 to the Regional Official Plan by Regional Council on
October 24, 1986.
Accordingly, Town Staff have prepared a by-law (attached) to rezone the
lands subject of Amendment No. 156 from "A-1 Agricultural" to
"A-Agricultural ". Staff note that the zone change will accommodate the
McMullan's request inasmuch as a commercial kennel is a permitted use within
the "A" zone. However, the zone designations for the golf course (A-8) and
a small pocket of "Environmental Protection (EP) " in Lot 9 are not affected
by the by-law. The "EP" zone encroaches on the northern portion of the
McMullen' s lot; the kennel buildings will therefore, need to be located
accordingly.
It is therefore recommended that the by-law attached to this Report be
forwarded to Council for approval .

BY-LAW NUMBER 86-
being a by-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
I. Schedule "1" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation of the lands indicated as
"LONE CHANGE FROM "A-1" TO "A" as indicated on the attached Schedule
"X" hereto.

Z. Schedule "X" attached hereto shall form part of this by-law.
3. This by-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning A ct.
