By-Law # METING: General Purpose and Administration Committee DATE: Monday, November 17, 1986 T #: PD-277-86 FILE #: DEV 86-54 SUBJECT: REZONING APPLICATION - BAS VANANDEL PART LOT 19, CONCESSION 5, DARLINGTON (HAMPTON) OUR FILE: DEV 86-54 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-277-86 be received; and 2. THAT the application submitted by Mr. Bas VanAndel to rezone lands in Part of Lot 19, Concession 5, in the former Township of Darlington, to permit the development of three (3) new Rural Hamlet residential lots be approved. BACKGROUND AND COMMENT: On September 19, 1986 the Planning Department received an application from Mr. B. VanAndel to rezone a 13,519m2 parcel of land to permit the development of three (3) additional lots in addition to an existing single family dwelling in the Hamlet of Hampton. The proposed rezoning would be to change the subject site from "Agricultural " to "Rural Hamlet". Staff has circulated the application to various agencies/departments for comment. There was also a public circulation to surrounding properties and a Public Notice was posted on the site. The following is a summary of the comments which have been received. . . .2 REPORT NO.: PD-277-86 Page 2 The following agencies have submitted their comments and have no objection to the proposal : 1. Town of Newcastle Community Services 2. Town of Newcastle Fire Department 3. Town of Newcastle Building Department 4. Northumberland & Newcastle Board of Education 5. Peterborough-Victoria-Northumberland & Newcastle Roman Catholic Separate School Board 6. Regional Health Unit 7. Ministry of Natural Resources 8. Ontario Hydro Town of Newcastle Community Services added a notation that 5% cash-in-lieu of parkland will be required for this site. Also, the Regional Health Unit noted that the tile bed for the existing home may have to be reloated. At the time severances are applied for, the Health Department will decide upon the suitability of the site for on-site sewage disposal . Town of Newcastle Fire Department had no objection to the application although one item was noted: "King Street is a dead end road with no turnaround facility for emergency vehicles. Turnaround facilities for any dead end portion of the access route exceeding 300 feet would be required under Section 2.5 of the Fire Code." The Planning Department has noted this concern and has referred the comment to the Works Department and suggested that these two Departments meet and discuss possible solutions. Staff would note that there is an existing farmhouse and a new home under construction, both of which are located to the west of this proposed development. The subject site is found to be in the Hamlet of Hampton as shown by the Regional Official Plan. The Plan encourages development within the Hamlet and permits minor additions thereto. This development is considered to be a minor extension to the existing Hamlet. This type of development is expected to be serviced by a drilled well and a private waste disposal system. . . .3 REPORT NO.: PD-277-86 Page 3 Each of the lots provide sufficient lot frontage and lot area. A number of conditions will be attached to the severances which will be required. These will include the removal of the existing barns, dedication of road widenings to the Town, and cash contribution towards road reconstruction. In addition, the Health Unit will also be required to approve the septic systems for each of the lots and lot development charges will be paid. Staff are of the opinion that this development is orderly and in keeping with the intent of the Official Plan and the Town of Newcastle Comprehensive Zoning By-law. Staff have received no major objections to the proposed change and therefore, recommends that the by-law amendment be approved. Respectful itted, r T.T. Box 1643 PORT PERRY, Ontario LOB 1NO THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 86- being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule "1" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Agricultural (A)" to "Residential Hamlet (RH) Zone" as shown on the attached Schedule 'T' hereto. 2. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
