SUBJECT: REZONING APPLICATION - ALECK MOFFAT
PART LOT 27, CONCESSION 4, FORMER TWP. OF CLARKE (ORONO)

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-278-86 be received; and
2. THAT the application submitted by Mr. Aleck Moffat to rezone a parcel of land
located in Part of Lot 27, Concession 4, former Township of Clarke (Orono), to
permit the development of ten (10) residential 1 of s on private services, be
approved and forwarded to Council for approval at such time as the applicant has
satisfied the Town that all lots will conform to the frontage and area requirements
of the "Residential Hamlet (RH)" zone of By-law 84-63, as amended.
BACKGROUND AND COMMENT:
On September 23, 1986 the Planning Department received an application from Mr. Aleck
Moffat to rezone a parcel of land to permit the development of an additional nine (9)
residential lots. Staff would note for the Committee' s information, that pursuant to
Council ' s resolution of July 26, 1982 and the requirements of the Planning Act, the
appropriate signage acknowledging the application was installed on the subject lands, and

surrounding property owners were advised of the proposal . Staff has also
conducted a circulation to verify the comments which were received from a
circulation for the Subdivision approval . At the time of the writing of
this report, no objections had been received.
This proposal has been recommended for draft approval by Council at its
meeting of Tuesday, October 14, 1986. This was an approval for a ten (10)
lot subdivision to be located immediately east of Highway 35/115. This
parcel of land was severed from the remainder of the applicant's land when
the new exit ramp to connect the highway to Somerville Drive was connected.
This site is located in the Hamlet of Orono, as designated by the Durham
Regional Official Plan. Durham Regional Planning Staff advised that this
development could not be considered as a minor extension to the Hamlet and
that a Development Plan is required prior to evaluation of the proposal .
Town Planning Staff are currently working on a draft development plan for
the Hamlet of Orono, but note that the Ministry of Municipal Affairs and
Housing has deferred approval of the majority of the Town's Official Plan,
including that section dealing with Hamlets. The proposed development
constitutes a minor extension to the Hamlet and would impact very little on
the development potential of the remainder of Orono inasmuch as athe
subdivision is to develop on private wells and therefore, would not be
dependent upon capacity being available in the municipal water system. In
Staff's opinion, the preparation of a Hamlet Development Plan as a
prerequisite for development of the proposed subdivision is not a reasonable
requirement and would impose unwarranted delays on development.
The Ganaraska Region Conservation Authority had no objection to the proposal
provided that the "Environmental Protection (EP)" zone was retained on the
northwest corner of the property. The rezoning which is proposed will not
encroach upon the existing "Environmental Protection (EP)" zone. The
remaining area is to be changed from "Agricultural (A-1)" to "Residential
Hamlet (RH)".

The Newcastle Community Services Department had no objections and noted that
cash-in-lieu of 5% parkland dedication will be required.
The Fire Department had the following comment:
"This Department has no objection to the above-headed application.
Emergency fire response would be from Station #3, which is within the
recognized five mile limit to a fire station. Water supply for firefighting
is with fire department tanker trucks. Consideration should be given to
Planning Department Report 40-84, Fire Protection for Rural Areas."
There were a number of requirements which are to be met to satisfy the
Ministry of Natural Resources and the Ministry of the Environment; each of
these are conditions attached to the Subdivision approval and will be dealt
with at that level .
The Town of Newcastle's Public Works Department has no objections in
principle to the proposal . There is a 3 metre road widening requested along
a portion of the south side of Somerville Drive and a 5 metre by 5 metre
sight triangle at the western corner of the cul-de-sac and Somerville Drive.
Both of these will be deeded to the Town free and clear of all encumbrances.
The applicant was also informed that the cul-de-sac is to be curved, not
straight with a corner. The Ontario Land Surveyor is noting the changes on
the plan.
The Ministry of Transportation and Communications had the following comment
on the Subdivision:
"Access to the subject lands will be restricted to Somerville Drive with
no direct access to the Provincial Highway. Permits will be required for
all buildings located within 1300 feet from the midpoint of intersecting
roads where our highways are concerned.
In the event noise attenuation measures are required by the Ministry of
Environment, we will require such features be placed outside of our highway
property limits."

The following agencies indicated no objection to the proposed subdivision:
1. Town of Newcastle Building Department
2. Northumberland and Newcastle Board of Education
3. Peterborough-Victoria-Northumberland and Newcastle
Roman Catholic Separate School Board
Staff has one concern which has not yet been fully satisfied. After the
road widening and the other changes are made to the Plan , Staff wishes to
see confirmation that the lot areas and frontages will conform to the
requirements of the "Residential Hamlet (RH)" zone. The surveyor is
completing the calculations although they will not be completed in time to
be included in this report. Staff is assured that the requirements can be
met with only minor changes to the lot lines. Once this concern has been
alleviated, Staff will have no objections to the proposal .
Staff, in consideration of the above-noted comments, and the status of the
subdivision, would have no objection to the approval of the application and
* by-law amendment attached hereto, provided the Ontario Land Surveyor
confirms that the lot frontages and areas conform to the Zoning By-law
requirements.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 86-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Schedule "1" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Agricultural (A-1)" to
"Residential Hamlet (RH) Zone" as shown on the attached Schedule 'T'
hereto.
2. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.
