RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-284-86 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and Administration Committee, Staff have
* prepared the attached list of applications to the Committee of Adjustment for the meeting
of November 5, 1986. This list includes the file number, applicant' s name, site location,
,.ype of variance requested, Official Plan Conformity, By-law Conformity, Staff's comments
on the applications and the Committee of Adjustment ' s decision.

APPLICATIONS:
A 69/86 - William James Stubbs, Lot 28, Concession 5, Clarke
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an attached garage
leaving a 6 ft. (1 .8 m)rear yard, instead of the required 7.5 m
rear yard.
Mr. Stubbs appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Barrie, seconded by Mr. Murdoch,
"THAT as the requested variance would not appear
to offend the intent of the Official Plan or Zoning
By-law and would not have a detrimental effect on
the surrounding neighbourhood, the variance is
considered minor in nature and permission is
GRANTED to construct an attached garage, leaving
a 6 ft. (1 .8 m) rear yard. "

A 69/86 - James R. Higgs, Lot 11 , Concession 7, Clarke
Application was made for relief from zoning by-law requirements in
order to permit the applicant to expand a legal non-conforming use by
an addition to the existing single family dwelling in an Environmental
Protection Zone.
Mr. Higgs appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Reicheld,
"THAT as the variance does not appear to offend the
intent of the Official Plan or Zoning By-law and
would not have a detrimental effect on the surrounding
neighbourhood this variance is considered minor in
nature and permission is GRANTED to expand a l.egal
non-conforming use by an addition to the existing
single family dwelling, conditional upon approval
of Ganaraska Conservation Authority. "

A 70/86 - R. W. MacLeod & Linda Doyle, Lot 11 , Conc. 3, Darlington.
Application was made for relief from zoning by-law requirements in
order to permit �he applicant to sever a parcel oft land with an
area of 4523.8 m , instead of the required 5000 m .
Mr. MacLeod appeared in support of this application. Mr. Adams,
Mr. Medd and Mr. Passant appeared in opposition to this application.
No other person appeared in support of or in opposition to this
application.
Moved by Mr. Reicheld, seconded by Mr. Murdoch,
"THAT as the proposed severance would create two
parcels of land which would not comply with the intent
of the Regional Official Plan and Zoning By-law, and
as the water system in the Subdivision was designed
to service only forty-six (46) lots, the application
is denied. "

A 71/86 - Robert J. Colby, Lot 26, Concession 7, Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to continue the use of an agricultural
building having a front yard of 15 ft. (4.5 m) , instead of the
required 15 m front yard.
R. Colby and friend appeared in support of this application. Mrs.
Sugden, Mr. and Mrs. Dilworth, Mr. & Mrs. White appeared in
opposition to this application. No other person appeared in
support or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Rehder,
"THAT as the location of the existing agricultural
building would appear to conform to the intent of
the Official Plan and Zoning By-law and is located
within the boundaries of the original farm building
but in a reduced size, permission is GRANTED to
continue the use of this farm building with a front
yard of 15 ft. (4.5 m) on condition that the building
be moved by the owner at his own expense at such time
as road widening becomes necessary and in the mean-
time no enlargements are to be made on this building. "

Moved by Mr. Murdoch, seconded by Mr. Barrie,
"THAT the minutes of the last meeting be approved
as circulated. "

Appeal date for the foregoing applications is December 5, 1986.
Next meeting of the Committee of Adjustment is November 26, 1986.
