PLAN OF SUBDIVISION - 18T-76048, PHASE II
COURTICE HEIGHTS DEVELOPMENT
PART LOT 31, CONCESSION 3, DARLINGTON
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
i
1. THAT Report PD-293-86 be received; and
2. THAT the request submitted by Mr. W.D. Manson, on behalf of Courtice Heights
Development, thereby exempting Lots 1 to 37 (inclusive) and Lots 100 to 108
(inclusive) , as shown on the Plan IOM-783 from Part Lot Control be acknowledged;
and
3. THAT the attached by-law be approved and forwarded to the Regional Municipality of
Durham pursuant to Section 49, Subsection (7) of the Planning Act; and
4. THAT Mr. W.D. Manson be so advised.
BACKGROUND AND COMMENT:
A request was received by Staff from Mr. W.D. Manson acting on behalf of Courtice Heights
Development for an exemption from Part Lot Control in respect of Lots 1 to 37 (inclusive)
and 100 to 108 (inclusive) in registered Plan of Subdivision IOM-783.

Staff have reviewed the request and would have no objection to same and the
approval of the by-law exempting the subject lands within this Plan from Part
* Lot Control . In that regard, attached hereto is a by-law which requires
approval of Council and the Regional Municipality of Durham which would exempt
the subject lands from Section 49(5) of the Planning Act pursuant to the
provisions of Section 49(7) of said Act.
Accordingly and in order to facilitate conveyance of title of the individual
semi-detached dwellings located on these lots, it would be appropriate for the
Council to approve the necessary exemption from Part Lot Control .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 86-
being a By-law to designate a certain portion of a Registered Plan as not
being subject to Part Lot Control.
WHEREAS the Council of the Town of Newcastle deems it desirable to
exempt, from Part Lot Control , Lots 1 - 37 (inclusive) and Lots 100 - 108
(inclusive) of Plan 1OM-783, registered at the Land Registry Office for
the Land Registry Division of Newcastle (No. 10) on September 24, 1986;
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle
enacts as follows:
1 . That Subsection (5) of Section 49 of the Planning Act shall not apply
to those lands described in Schedule "A" to this by-law.
2. This by-law shall come into effect upon being approved by the
Regional Municipality of Durham, and thereafter Subsection (5) of
Section 49 shall cease to apply to the lands described in Schedule
"A" hereto.
3. Schedule "A" attached hereto shall form part of this by-law.

SCHEDULE "A" TO BY-LAW NUMBER 86-
The provisions of this By-law 86-_ shall apply to the lands listed
below.
