RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-304-86 be received; and

2. THAT the application for rezoning Part of Lot 12, Concession 1 , former Town of
Bowmanville (12 Temperance Street), submitted by Mr. W. Allen and Ms. N. Dawson, to �
permit the property to be used as a Motor Vehicle Repair Garage, be approved; and
3. THAT the By-law attached hereto to amend By-law 84-63, as amended, be approved and
forwarded to Council after the site plan control approval is finalized.
BACKGROUND AND COMMENT:
On October 10, 1986 the Planning Department received an application from Mr. W. Allen for
rezoning a Part of Lot 12, Concession 1, in the former Town of Bowmanville, known
municipally as 12 Temperance Street.

The subject lands are currently zoned as "Urban Residential Type One (R1 )"
by the Comprehensive Zoning By-law 84-63, as amended.
The Regional Official Plan and the Bowmanville Urban Area Plan have this
site designated within the Main Central Area as "Commercial ". The Regional
Planning Department has confirmed that the "Commercial " development conforms
to the intent of the Plan.
Staff would note for the Committee' s information that, pursuant to Council 's
resolution of July 26, 1982 and the requirements of the Planning Act, the
appropriate signage acknowledging the application was installed on the
subject lands. Staff would note that no objections to the proposal were
received at the writing of this Report with respect to the amendment
requested.
In accordance with departmental procedures, the application was circulated
to obtain comments from other departments and agencies as noted with Staff
Report PD-254-86. Staff would note the following de partments/agencies, in
providing comments, offered no objections to the application as filed:
- Town of Newcastle Community Services Department
- Town of Newcastle Fire Department
- Town of Newcastle Building Department
- Newcastle Hydro Electric Commission
- Regional Health Services Department

The proposal is to use the site as a Motor Vehicle Repair Garage, with no
intent to sell vehicles or to sell fuel for vehicles. Staff has carried out
a thorough circulation and has received no objections from any technical

agency nor from an g g
y persons who were notified of the zoning change.

Concern had been raised by the Regional Works Department regarding the
i
i
servicing of this site. These questions have been resolved and there is no
longer any problems surrounding the servicing as set out in Section 8.2.3.2 j
of the Official Plan. The site does have an existing water supply and
sewage disposal system.

The site was previously owned by Ontario Hydro and used by this public
utility as a storage depot. Prior to this, the original brick building was
used as a public garage. This type of non-residential development appears
to be a reasonable use for this site.
Staff does not have any objection to the rezoning of this site, but will
require that the site plan will have to be finalized before Staff can
* recommend that the by-law attached hereto can be forwarded to Council .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 86-
being a By-law to amend By-law 84-63, Comprehensive Zoning By-law
of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Section 16.1 is hereby amended by adding thereto, the
following new Subsection 16.5.5 as follows:
"16.5.5 GENERAL COMMERCIAL EXCEPTION (C1-5) ZONE
(a) Notwithstanding Section 16.1, in addition to the permitted
uses, those lands zoned "C1-5" on Schedule 3 to this
By-law may also be used for a Motor Vehicle Repair
Garage."
2. Schedule 3 to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Urban Residential Type
One (R1)" to "General Commercial Exception (C1-5) Zone", as indicated
on the attached Schedule "X" hereto.
3. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act,
1983.
