OF DARLINGTON 'c 0 FILE: A 72/86 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-305-86 be received; and 2. THAT the decision of the Committee of Adjustment to permit an accessory building of 1,536 square feet, for the storage and service of a transport truck cab, be appealed to the Ontario Municipal Board. BACKGROUND AND COMMENT: On November 12, 1986, the Planning Department received a request from the Committee of Adjustment to comment upon an application for a minor variance. The application was to permit an accessory building which would exceed the maximum permitted lot coverage. The site is within the Hamlet of Mitchell 's Corners and is designated as "Residential " in the Official Plan. Zoning By-law 84-63, as amended, of the Town of Newcastle shows the site as being in the "Residential Hamlet (RH)" zone. . . .2 REPORT NO. : PD-305-86 Page 2 / The application as filed, appeared to be requesting a variance for a building which would be used for vehicles customarily associated with a residential use. In the comments to the Committee, Staff were concerned with the excessive size of the building. Staff recommended that the building be scaled down to that of a double car garage with storage. At the meeting it was made clear that the main function of this building was to be the storage of and servicing of a large commercial vehicle. The Zoning By-law is designed to prevent the storage of such vehicles within the residential areas of the Town. Such a use is much more appropriate within the "Industrial " and "Agricultural " zones and the By-law has made provisions for this type of use in these zones. Staff is concerned about the noise and the pollution which can be caused by a use such as this. Staff also does not believe that such a use is in keeping with the intent of the "Residential Hamlet" zone. This zone permits only single detached dwellings, home occupations and places of worship; none of which would normally be associated with transport trucks. Staff does not consider this type of use appropriate and recommends that the decision be appealed prior to the final date for appeal of December 26, 1986.
