SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT
APPLICATIONS FOR THE MEETING OF
MARCH 26, 1986
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-101-86 be received for information.

of March 26, 1986. This list includes the file number, applicant's name, site location,
type of variance requested, Official Plan Conformity, By-law Conformity, Staff's comments
on the applications and the Committee of Adjustment's decision.

APPLICATIONS:
A 6/86 - Frederick J. & Dorothy E. King, Lot 35, . Conc. _ 4, _Darlington. -
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a 720 sq. ft. accessory
building which would exceed the maximum requirement of not more than
40% of the main building total floor area.
Fred King appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Heming,
THAT as the proposed variance does not appear to
offend the intent of the Official Plan or Zoning
By-law and due to the location of the proposed
accessory building would not appear to have a
detrimental effect on the surrounding neighbourhood
and with the size of the existing single family
dwelling the accessory building allowed by zoning
by-law would be extremely small , this application
is considered minor and permission is GRANTED to
construct a 720 sq. ft. accessory building.

Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an addition to the existing
dwelling leaving a side yard of 4 ft. (1 .2 m) , instead of the required
2 m (6.56 ft. ) side yard.
John Jenkins appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Heming,
"THAT as the proposed variance appears to conform
with the requirements of the Official Plan and
Zoning By-law and due to the location would not
have a detrimental effect on the surrounding
properties, permission is GRANTED to construct
the additi;onleaving a side yard of 1 .2 m (4 ft. ) ."

A 8/86 - Steven A. Sylvester, Lot 35, Concession 2, - Darlington. .
Application was made for relief from zoning by-law requirements in
order to permit the applicant to use a portion of the existing
building, with an existing 5.77 m front yard and 4.03 m side yard,
for a Commercial use, instead of the required 15 m front yard and
5 m side yard for a Commercial usage.
Steven Sylvester appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Murdoch,
"THAT as the proposed variance would appear to comply
with the intent of the Official Plan and Zoning By-law
and as the existing building is now surrounded by
properties that have Commercial uses, permission is
GRANTED to use a portion of the building for Commercial
use and to maintain the existing 5.77 m front yard and
4.03 m side yard instead of the required 15 m front
yard and 5 m side yard. This approval is conditional
on the applicant submitting and obtaining site plan
approval with respect to the proposed use. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to extend a legal non-conforming use by
the reconstruction and enlargement of existing porches and the con-
struction of a 365 sq. ft. addition to the rear of the existing legal
non-conforming building.
Mr. and Mrs . Howe appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Rehder, seconded by Mrs. Payne,
THAT as the proposed variance would not appear to
offend the intent of the Official Plan or Zoning By-
law and would not appear to have a detrimental effect
on the surrounding neighbourhood, permission is
GRANTED to expand a legal non-conforming use by the
construction and enlargement of the existing porches
and the 365 sq„ ft, addition at the rear, "
