F. SHANE OUR FILE: Pln 8.5(b) RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-104-86 be received; and 2. THAT the application submitted by Darlington Auto Sales for a variance from the Town of Newcastle Sign By-law, in respect of a roof sign, be denied and the applicant so advised. BACKGROUND AND COMMENTS: On April 3, 1986 Staff received an application from Mr. Frank Shane, the Owner of Darlington Auto Sales, requesting a variance from By-law 76-25, as amended, to permit erection of a roof sign. Mr. Shane's application was supported by two (2) pieces of correspondence from adjacent property owners which correspondence indicated that those persons favoured a roof sign over a ground sign. Staff note that the property subject of the application is currently the subject of a number of charges relative to the Ontario Building Code and the Town of Newcastle's Zoning . . .2 /0 REPORT NO.: PD-104-86 page 2 l By-law. In that regard, the building upon which the sign has already been erected contravenes the Ontario Building Code and the Town of Newcastle Zoning By-law. The building upon which it is located was situated on the site without benefit of a building permit as was a small shed immediately to the east of said building. The proposed sign would be contrary to the intent of the Sign By-law in three (3) respects and Staff do not feel that a variance is warranted. In the first instance, the sign was erected without benefit of a permit, in the second, the by-law contains a specific prohibition on roof signs, and in the third instance, the sign by-law requires that a permit not be issued in a case where the erection of a sign would indicate or abet the contravention of any zoning by-law or regulation enforcable in the Corporation of the Town of Newcastle. Inasmuch as the erection of a building on this lot, for the use as an Automobile Sales Office, contravenes the provisions of By-law 84-63, a Sign Permit is not available at all . In order to obtain a Sign Permit, the use must be legalized. Town Staff are of the opinion that to do so the property owner will require an amendment to the Official Plan for the Bowmanville Urban Area, an amendment to the Town of Newcastle Zoning By-law, execution of a Development Agreement with the Town of Newcastle, and issuance of a building permit. The applicant's request for a variance to permit issuance of a sign permit and the erection of a roof sign would, in Staff' s opinion , significantly contravene the intent of the Sign By-law and we would therefore recommend that the variance not be granted.
