HomeMy WebLinkAboutPD-105-86 TOWN OF NEWCASTLE Y REPORT File #60J1 0 Res. #. �'/' ` 6( By-Law 7� (STING: General Purpose and Administration Committee DATE: Monday, April 21, 1986 REPORT #: PD-105-86 FILE #: Pln 18.1 SUBJECT: L.A.C.A.0 REQUEST TO DESIGNATE: - ORONO TOWN HALL, MAIN AND PARK STREETS, ORONO - 117 QUEEN STREET, BOWMANVILLE - 9 - 11 DUKE STREET, BOWMANVILLE - "JOHN STALKER HOUSE", NORTH PART OF LOT 30, CONCESSION 6, CLARKE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-105-86 be received; and 2. THAT the request of the Town of Newcastle Local Architectural Conservation Advisory committee to designate as historical sites the Orono Town Hall , the residences at 117 Queen Street, Bowmanville and 9 - 11 Duke Street, Bowmanville, and the residence known as the John Stalker House in Part Lot 30, Concession 6, former Township of Clarke be approved; and 3. THAT the Clerk prepare, send and publish the required notices of intent pursuant to Section 29 of the Heritage Act and to report back to Council following the prescribed notification period. BACKGROUND: On March 25, 1986, the Planning Department received copies of requests submitted by the Local Architectural Conservation Advisory Committee (L .A.C.A.C. ) to designate one (1) municipally owned building and three (3) private residences as historical sites. . . .2 REPORT NO.: PD-105-86 Page 2 In reviewing the requests, Staff note that the Ontario Heritage Act, Part IV, empowers a municipality to designate a Property within the Municipality to be of historic or architectural value or interest. As well , Staff note that Sections 7.2.11 and 8.2.10 of the Town of Newcastle Official Plan provide that Council , upon the advise of L .A.C.A.C., may designate specific structures or sites having historical or architectural significance under the Ontario Heritage Act. These policies, however, only apply to properties located within the Urban Areas of Bowmanville and Newcastle Village. The Town of Newcastle Official Plan and the Durham Regional Official Plan are silent on the designation of sites within Hamlets or within the rural areas of the Town. The following is a summary of Official Plan policies and zoning by-law designations as they relate to each property. 117 Queen Street, Bowmanville Town of Newcastle Official Plan - "Community Facilities" By-law 84-63 - "Rl-Urban Residential Type One" 9-11 Duke Street, Bowmanville Town of Newcastle Official Plan - "Low Density Residential " By-law 84-63 - "Rl-Urban Residential Type One" Orono Town Hall Town of Newcastle Official Plan - "Hamlet" By-law 84-63 - "C1-2 - General Commercial Special Exception Two" John Stalker House, Part Lot 30, Concession 6, Clarke Durham Regional Official Plan - "General Agricultural Area" By-law 84-63 - "A-Agricultural " . . .3 REPORT NO. : PD-105-86 Page 3 ow The proposed historical designation of the four (4) subject properties would not offend the intent of Official Plan policies or By-law 84-63. With respect to Official Plan, the designation of 117 Queen Street, Bowmanville as "Community Facilities", Planning Staff have been advised by the Community Services Department that the designation of the subject property as an historical site would not conflict with the Town's plans for that area. COMMENTS: Inasmuch as the proposed historical designation for the four (4) subject properties would not offend the intent of Official Plan policies and the Comprehensive Zoning By-law, Staff would have no objection to their designation as heritage properties. In accordance with the provisions of the Ontario Heritage Act, where Council intends to designate a property to be of historic or architectural value , it must provide notice of intention after consultation with L.A.C.A.C. However, since the subject requests have been initiated by the Local Advisory Committee, Council may, if it deems advisable, proceed to provide notice of intent to designate in accordance with the requirements prescribed by the Ontario Heritage Act. Therefore, it would be appropriate for Council to approve the requests and to initiate the necessary procedures. ,Respectfu itted, .4. E wards, M.C. I.P.
