COURTICE HEIGHTS DEVELOPMENTS LIMITED
PART LOTS 31 and 32, CONCESSIONS 2 and 3, DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-106-86 be received; and
2. THAT Council adopt the following resolution:
"THAT the correspondence from Ronald K. Webb, Q.C. , dated April 7,
1986, be received and the Ontario Municipal Board be advised that the
Corporation of the Town of Newcastle has no objections to the extensions
to the draft plan of approval of Plans 18T-76048 and 18T-76027 to June
12, 1987"; and
3. THAT the request in 2 above be forwarded to the Ontario Municipal Board
and that Courtice Heights Developments Limited be so advised.
BACKGROUND AND COMMENT:
A copy of the attached letter was received by the Planning and Development on April
7, 1986. The letter, jointly addressed to the Region of Durham and the Town of
Newcastle, from Messrs. Davis, Webb, Barristers & Solicitors, on behalf of Courtice
Heights Development Limited, request approval of an additional one (1) year
extension in draft approval of Subdivisions 18T-76048 and 18T-76027 located in Part

of Lot 31, Concession 3 and Part Lot of Lots 31 and 32, Concession 2, former
Township of Darlington. Mr. Webb advises that his client has registered
Phase 1 of the northern subdivision 18T-76048 on March 14, 1986. Inasmuch
as this development will be proceeding in the near future, a request is made
for an extension of time for the registration of the remainder of the
Subdivision Plan.
Staff would note for the Committee's information that the Subdivision
Agreements between the Town of Newcastle and Courtice Heights (South and
North) were registered on title September 28, 1983 and May 8, 1984
respectively. Staff would note for the Committee' s information that in
consideration of the terms and obligations within each subdivision
agreement, the Owners have recently complied with the requirements for the
appropriate payments for the external stormwater drainage facilities
servicing the Courtice Heights Developments .
In consideration of the above-noted comments, Staff would have no objections
to the extension of draft plan approval for a further one (1) year period to
June 12, 1987 with respect to each plan being 18T-76027 and 18T-76048.

Re : Courtice Heights Developments, Plans of Subdivision
18T-76027 (OMB file R771832) - southern subdivision
18T-76048 (OMB file R7718'33) northerni subdivision
Our client advises that Phase 1 of the northern subdivision (18T-
76048) was registered on March 14 , 1986 . We hereby request a
further extension of time for the registration of the remainder
of the subdivision plan.
Our client also requests an extension of time for the registration
of the southern subdivision (18T-76027) .
Although interest has been expressed by builders with respect to
the subdivisions , our client has not entered into any final
contacts at this time.
As draft plan approval expires with respect to both subdivisions
on June 12 , 1986 , we would appreciate if you would write to the
Ontario Municipal Board (with a copy of your letter for our files)
consenting to the extension of draft plan approval for a further 12
months with respect to each of these subdivisions .
