HomeMy WebLinkAboutPD-109-86 J�°� " � TOWN OF NEWCASTLE REPORT File Res. # _¢ By-Law # MEETING: General Purpose and Administration Committee DATE: Monday, May 5, 1986 REPORT #: PD-109-86 FILE #: 18T-81034 SUBJECT: EXEMPTION FROM PART LOT CONTROL PLAN OF SUBDIVISION 18T-81034 - PHASE II GATEHOUSE HOLDINGS LIMITED PART LOT 35, CONCESSION 2, DARLINGTON RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-109-86 be received; and 2. THAT the request submitted by Mr. Alan Berk, Solicitor, on behalf of Gatehouse Holdings, thereby exempting Lots 98 - 127 ; 143 - 153; 158 - 179 as shown on the draft plan of subdivision 18T-81034; more particularly described as Lots 27 - 60; 68 - 78; 83 - 100 on a draft M-Plan from Part Lot Control be acknowledged; and 3. THAT the attached by-law exempting said lots be forwarded to Council for approval following the registration of the M-Plan; and 4. THAT the by-law will , at such time, be forwarded to the Regional Municipality of Durham pursuant to Section 49, Subsection (7) of the Planning Act; and 5. THAT Mr. Alan Berk be so advised. . . .2 REPORT NO.: PD-109-86 Page 2 BACKGROUND AND COMMENT: On April 10, 1986, Staff received a request from Mr. Alan Berk acting on * behalf of Gatehouse Holdings Limited (see attached) , for an exemption from Part Lot Control with respect to the lots within the draft plan of subdivision which are zoned to permit "link homes". Staff would note for the Committee' s information that the required Subdivision Agreement pertaining to Phase II developments has been forwarded to the applicant for its proper execution and is anticipated to be returned shortly for the Town's execution and subsequent registration. With respect to the Part Lot Control exemption request, Staff would have no objection to same, noting that pursuant to the provisions of Section 49(5) and 49(7) prior to the passing of the requested by-law, the Plan of Subdivision being the M-Plan is to be properly registered on title. Accordingly and in order to facilitate conveyance of title of the individual units located on the lots in question, Staff would have no objections to the approval of the Part Lot Control By-law subject to the conditions as noted within Staff's recommendations. -?Respec vi-_ ubmit d, �Cl T.T. Attention: Mr. Larry Taylor Dear Sir: With respect to the above noted this will confirm our recent telephone conversation wherein we formally requested that the Town of Newcastle, proceed as expeditiously as possible, to pass the necessary part lot control exempting by-law under the Planning Act of the Province of Ontario, with respect to the lots which are zoned for "link houses" on the above noted draft plan. Should you require any further or other information in this regard, please do not hesitate to contact our offices. Kindly advise when the by-law has been passed by council and forwarded to the Region for final approval. Yours truly, ALAN BERK DR III I i I I I THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 86- being a By-law to designate a certain portion of a Registered Plan as not being subject to Part Lot Control. WHEREAS the Council of the Town of Newcastle deems it desirable to exempt, from Part Lot Control , Lots 27 - 60; 68 -78; 83 - 100; (inclusive) of Plan 1OM-_, registered at the Land Registry Office for the Land Registry Division of Newcastle (No. 10) on 1986; NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. That Subsection (5) of Section 49 of the Planning Act shall not apply to those lands described in Schedule "A" to this by-law. 2. This by-law shall come into effect upon being approved by the Regional Municipality of Durham, and thereafter Subsection (5) of Section 49 shall cease to apply to the lands described in Schedule "A" hereto. 3. Schedule "A" attached hereto shall form part of this by-law. BY-LAW read a first time this day of 1986. BY-LAW read a second time this day of 1986.
