RECOMMENDATIONS:
It is respectfully recommended to Council the following:
1. THAT Report PD-113-86 be received for information.
BACKGROUND AND COMMENT:
On April 14, 1986, Council resolved (Resolution #C-320-86) to endorse the decision of
the General Purpose and Administration Committee to deny Mr. Mangar's rezoning
application insofar as it relates to the proposed bodyshop and paintspray booth.
Staff have prepared a by-law (attached) to rezone the Mangar property from
"C6-Service Station Commercial " to "C6-7-Service Station Commercial Special Exception
7". The provisions of the "C6-7" zone would permit the sale of motor vehicles and
motor vehicle parts as ancillary uses to the service station, and include a
restriction on the maximum number of vehicles to be displayed for sale and the
maximum area of the service station building. The zone provisions also specifically
prohibit the operation of a motor vehicle bodyshop.

A Development Agreement between the Town and the applicant has been
registered on title of the subject lands. The Agreement includes
provisions requiring the provision of on-site landscaping and a privacy
fence to screen the subject lands from adjacent properties. The
Agreement also specifically prohibits the operation of a bodyshop. The
Agreement however, does not contain a provision limiting the hours of
operation.
The by-law rezoning Mr. Mangar's property has been included in today's
agenda for first, second and third readings of Council .

Re: Resolution CPA-306-86

I act as solicitor for Mr. and Mrs. William
Grady, who are in opposition to the by-law represented by the subject Resolu-
tion. We were in attendance at the Council meeting on April 14, 1986, and
noted that the Report of the General Purpose Committee was accepted by
Council but that the actual argument regarding the by-law would not be held
until the draft by-law was before the Council.
I received some information that that would
not likely occur for a further two weeks and I am simply indicating as follows:
(a) That Mr. and Mrs. Grady wish to appear as a
delegation and express their opposition to the passing of the by-law.
(b) We would ask that you provide us with notice
when that Council meeting will occur so that we have sufficient time to make
our preparation and our representations.
I am bringing this file forward to the 28th of
April and hopefully by that time you can indicate when the next Council meeting
will be that will cover this issue.
