APPLICATIONS FOR THE MEETING OF
APRIL 16, 1986
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-115-86 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and Administration Committee, Staff have
* prepared the attached list of applications to the Committee of Adjustment for the meeting
of April 16, 1986. This list includes the file number, applicant's name, site location,
type of variance requested, Official Plan Conformity, By-law Conformity, Staff's conments
on the applications and the Committee of Adjustment's decision.

APPLICATIONS:
A 10/86 - Noel C. Gordon, Lot 27, B.F. Concession,. Newcastle.
An application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a 126.9 sq. m (1366 sq.ft. )
single family dwelling, instead of the required 139 sq. m single family
dwelling.
Mr. and Mrs. Gordon appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Murdoch,
"THAT as the proposed variance appears to conform
with the intent of the Official Plan and the Zoning
By-law (with the exception of the floor area) , and
as the replacing of the old cottage with a new home
would enhance the appearance of the area, permission
is GRANTED to construct a 126.9 sq. m single family
dwelling, instead of the required 139 sq. m single
family dwelling. This approval is conditional on
the demolition of the existing cottage. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to re-construct and enlarge the
verandah on an existing single family dwelling which will encroach
the required front yard by 11 ft. , instead of the required not more
than 1 .5 m (4.9 ft. )
Mr. Lanteigne appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Barrie, seconded by Mr. Reicheld,
"THAT as the proposed variance would not appear to
offend the intent of the Zoning By-law or Official
Plan or have an adverse effect on the surrounding
properties and will not encroach into the front
yard as far as some of the adjacent dwellings,
permission is GRANTED to re-construct and enlarge
the verandah, encroaching the required front yard
by 11 ft. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a 660 sq. ft. accessory
building which would exceed the maximum requirements of not more
than 40% of the main building total floor area.
Mr. MacDonald appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Heming, seconded by Mr. Murdoch,
"THAT as the use of the proposed accessory building
for a work shop and garage would not appear to
offend the intent of the Zoning By-law or Official
Plan or have a detrimental effect on the surrounding
properties, the variance is considered minor in
nature and permission is GRANTED to construct a
660 sq. ft. accessory building. "

A 13/86 - Cheryl . &. Robert Waterfall , Lot 29, . Conc. . l - Village. -
Application was made for relief from zoning by-law requirements
in order to permit the applicant to place a 180 sq. ft. accessory
building on the lot which would exceed the maximum requirement of
total accessory buildings to be not more than 40% of the main
building total floor area.
Mr. Waterfall appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Rehder, seconded by Mr. Murdoch,
"THAT as the requested variance would not appear to
offend the intent of the Zoning By-law or Official
Plan and due to the location of the accessory
building at the far end of the lot would not appear
to have a detrimental effect on the surrounding
properties, permission is GRANTED to place an
additional 180 sq. ft. accessory building on the lot. "

Moved by Mr. Heming, seconded by Mr. Rehder,
"THAT the minutes of the last meeting be approved
as circulated."

Appeal date for the foregoing applications is May 16, 1986.
Next meeting of the Committee of Adjustment is May 7, 1986.
