HomeMy WebLinkAboutPD-128-86 TOWN OF NEWCASTLE REPORT File # Res_ #_A, /9-1/I,/-� By-Law # MEETING: General Purpose and Administration Committee DATE: Tuesday, May 20, 1.986 REPORT #: PD-128-86 FILE #: 1.8T-76044 SUBJECT: EXEMPTION FROM PART LOT CONTROL PLAN OF SUBDIVISION 18T-76048 - PHASE I COURTICE HEIGHTS DEVELOPMENT PART LOT 31, CONCESSION 3, DARLINGTON RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: I. THAT Report PD-128-86 be received; and 2. THAT the request submitted by Mr. George Smith, Solicitor, on behalf of Copperfield Homes Limited, thereby exempting Lots 182 - 188; 2.02 - 210; and 8 - 22 as shown on the draft plan of subdivision 1.8T-76048; more particularly described as Lots 63 - 69; 83 - 91; 8 - 22 on IOM-772 from Part Lot Control be acknowledged, and 3. THAT the attached by-law be approved and forwarded to the Regional Municipality of Durham pursuant to Section 49, Subsection (7) of the Planning Act; and 4. THAT Mr. George Smith be so advised. . . .2 REPORT NO. : PD-1.2.8-86 Page 2 BACKGROUND AND COMMENT: On April 30, 1986, Staff received a request from Mr. George Smith acting on behalf of Copperfied Homes Limited for an exemption from Part Lot Control in respect of Lots 8-22, 1.827188 and 2.02-2.10 in registered Plan of Subdivision 1OM-772. Staff have reviewed the request and would have no objection to same and the approval of the by-law exempting the subject lands within this Plan * from Part Lot Control . In that regard, attached herein is a by-law which requires approval of Council and the Regional Municipality of Durham which would exempt the subject lands from Section 49(5) of the Planning Act pursuant to the provisions of Section 49(7) of said Act. Staff would note for Committee' s information that in consideration of the request submitted by Mr. Smith , on behalf of a potential purchaser of the subject lands, Staff has taken the opportunity to contact the present landowners to confirm their acknowledgement and concurrence with the request as submitted. Accordingly and in order to facilitate conveyance of title of the individual semi-detached dwellings located on these lots, i t would appropriate for the Council to approve the necessary exemption from Part Lot Control . espectf N'' tTbmitted, T.T. LOB 1 N0.-:(416)985-8465 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 86- being a By-law to designate a certain portion of a Registered Plan as not being subject to Part Lot Control. WHEREAS the Council of the Town of Newcastle deems it desirable to exempt, from Part Lot Control, Lots 63 - 69; 83 - 91; 8 - 22; (inclusive) of Plan 1OM-772, registered at the Land Registry Office for the Land Registry Division of Newcastle (No. 10) on March 14, 1986; NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows; 1. That Subsection (5) of Section 49 of the Planning Act shall not apply to those lands described in Schedule "A" to this by-law. 2. This by-law shall come into effect upon being approved by the Regional Municipality of Durham, and thereafter Subsection (5) of Section 49 shall cease to apply to the lands described in Schedule "A" hereto. 3. Schedule "A" attached hereto shall form part of this by-law. BY-LAW read a first time this day of 1986. BY-LAW read a second time this day of 1986.
