RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-129-86 be received for information.
BACKGROUND AND COMMENTS:
At its regular meeting on April 7, 1986 Council heard a delegation from Mr. B. Heming in
respect of the Town of Newcastle' s Comprehensive Zoning By-law and specifically Section
3.19, Subsections (c) and (d) of said By-law. Mr. Heming identified certain problems with
these Sections of the By-law arising from his personal experience with the interpretation
of these Sections, an application to the Committee of Adjustment and the resultant Ontario
Muncipal Board Hearing. Mr. Heming also expressed some concerns with respect to the
By-law's parking requirements and the need for Staff to undertake ongoing review of the
By-law provisions. Mr. Heming' s presentation was referred to Staff for review and a
subsequent report.
Following therefrom, Staff on April 8, 1.986 met with Mr. Heming to discuss his concerns as
well as a number of other related matters. In that regard, Mr. Heming was advised that
there were currently some amendments in process dealing with improving Section 3.19,

Subsection (c) , however, those changes did not extend to address the
particular concern that he had expressed relative to exemption from the
agricultural separation where the proposed lot would be located within a
Hamlet. It was noted for Mr. Heming's benefit that that particular
requirement of the By-law arises, principally, from the Durham Regional
Official Plan which requires, as a minimum, compliance with the Agriculture
Code of Practice. It was therefore felt that the changes suggested by Mr.
Heming would necessitate an amendment to the Durham Regional Official Plan,
which amendment would be inconsistent with the current Provincial Foodland
Guidelines.
With respect to the issue of parking area sizes, Mr. Heming was advised that
his concern was noted and that any recurring application to the Committee of
Adjustment is identified as a potential amendment to the Comprehensive
Zoning By-law and considered at year end as part of our annual review of the
By-law. In this particular instance we have only had the one (1 )
application for reduction in parking space size, however, in view of the

information that was filed by the applicant, further consideration is
warranted and Staff have noted this as an item for review at year end.

Mr. Heming was also advised that in addition to our annual review of the
Zoning By-law, we are continually noting problem areas with Official Plans
and reviewing Ontario Municipal Board decisions and Committee of Adjustment
decisions relevant to same. Mr. Heming appeared to be satisfied with these
explanations and was invited to contact the Planning Staff at any time
should he perceive or identify a problem relevant to any Municipal Planning
policy or regulation.
