APPLICATIONS FOR THE MEETING OF
MAY 7, 1986
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
I. THAT Report PD-138-86 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and Administration Committee, Staff have
* prepared the attached list of applications to the Committee of Adjustment for the meeting
of May 7, 1986. This list includes the file number, applicant's name, site location, type
of variance requested, Official Plan Conformity, By-law Conformity, Staff's comments on
the applications and the Committee of Adjustment's decision.

APPLICATIONS:
A 14/86 - Jerry C.. Piels,. Lot- 14, Conc.. l , . Bowmanville..
Application was made for relief from zoning by-law requirements
in order to permit the applicant to construct a 660 sq. ft. accessory
building which would exceed the maximum requirement of not more than
40% of the main building total floor area.
Mr. Piels appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mr. Heming, seconded by Mr. Murdoch,
"THAT as the requested variance would not appear to
offend the intent of the Zoning By-law or Official
Plan or have a detrimental effect on the surrounding
properties and taking into account the fact that the
existing house is very small therefore making the
maximum required garage very small , permission is
GRANTED to construct a 660 sq. ft. accessory
building. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an addition to the
existing Industrial building, leaving a side yard of 6.38 m.
No person appeared in support of or in opposition to this application.
Moved by Mr. Reicheld, seconded by Mr. Murdoch,
"THAT as the requested variance would appear to
conform with the intent of the Official Plan and
the provisions of the Zoning By-law and would not
appear to affect or influence site line require-
_ ments for vehicular traffic on Simpson Avenue,
permission is GRANTED to construct the addition
leaving a side yard of 6.38 metres, instead of the
required 14 m side yard. This approval is subject
to the Site Plan being amended to suit the require-
ments of the Planning Dept. and also conditional
upon the approval of C.L.O.C.A."

Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a 576 sq. ft. accessory
builiing which would exceed the maximum requirement of not more
than 40% of the main building total floor area.
Mr. Mitchell appeared in support of this application. No other
person appeared in support of or in opposition to this applciation.
Moved by Mrs. Payne, seconded by Mr. Murdoch,
"THAT as the requested variance would not appear
to offend the intent of the Zoning By-law or
Official Plan or have a detrimental effect on
the surrounding properties, permission is
GRANTED to construct a 576 sq. ft. accessory
building which would exceed the maximum
requirement of not more than 40% of the main
building total floor area. "

"THAT as the requested variance would not appear to
offend the intent of the Zoning By-law or Official
Plan and would not appear to have a detrimental
effect on surrounding properties, permission is
GRANTED to construct a 562 sq. ft. accessory
building. "

order to permit the applicant to construct a 576 sq. ft, accessory
building which would exceed the maximum requirement of not more
than 40% of the main building total floor area.
Mr. Crossey appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Heming,
"THAT as the requested variance would not appear to
offend the intent of the Zoning By-law or Official
Plan or have a detrimental effect on the surrounding
properties, the variance is considered minor and
permission is GRANTED to construct a 576 sq. ft.
accessory building. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to create a parcel of land with an
area of 2090 sq. m (22,500 sq. ft. ) , instead of the required area
of 3000sq. m.
Mr. & Mrs. Hayman appeared in support of this application. No
other person appeared in support of or in opposition to this
application.
Moved by Mrs. Payne, seconded by Mr. Rehder,
"THAT as the requested variance would not appear to
offend the intent of the Zoning By-law or the Official
Plan, and as most of the other lots in the same area
have less area than the new proposed lots, permission
is GRANTED to create a lot with an area of 2090 sq. m
(22,500 sq.ft. ) , instead of the required 3000 sq.m. "

14.45 m, instead of the required 15 m frontage.
Moved by Mr. Rehder, seconded by Mr. Barrie,
"THAT the committee accept the withdrawl of this
application at the request of the applicant."

"THAT the minutes of the last meeting be approved
as circulated. "

Appeal date for the foregoing applications is June 6, 1986.
