PHASE III - SCHLEISS AND HOLLAND
PART LOT 34, CONCESSION 3, GEOGRAPHIC TWP. OF DARLINGTON
RECOMMENDATIONS:
It is respectfully recommended to Council the following:
1. THAT this r-epor•t be r-eceived for- information.
BACKGROUND AND COMMENT:
On May 7 and 14, 1986, Staff received copies of petitions circulated by W. Michael
Majeste in respect of two (2) townhouse blocks within draft approved Plan of
Subdivision 18T-77001 . These petitions were placed on the agenda for- Council 's
consideration with W. Majeste scheduled to be a delegation in respect of this
matter.
Staff met with My-. Majeste and W. Di Rienzo in or-der- to ascertain the exact nature
of their- request and it is Staff' s understanding, based upon those discussions and
the petitions r-eceived, that a number- of r-esi dents within the fi r-st two phases of
the Holland and Schleiss subdivision ar-e opposed to the development of two (2)
parcels of land presently designated for- Medium Density townhouse development. The
basis for- their- objection being that, in their- opinion, pr-oper•ty values will be
affected and that the location of the proposed townhouse blocks r•epr•esents
poor-2

planning and will create a traffic hazard and a school over-cr-owding
situation.
Staff note that the particular- Plan of Subdivision received draft plan
approval from the Ministry of Housing on January 28, 1981 . Said approval
included two (2) parcels of land designated for- development of a total of
thirty-three (33) townhouse units. Inclusion of medium density housing,
within this Plan of Subdivision, was consistent with the policies of the
Official Plan in respect of providing a mix of housing types and with the
intent of the OHAP Agreements entered into with the Province of Ontario
for, services in the Cour•tice area. The location of the medium density
blocks is consistent with the approved Neighbourhood Development Plans
and ar-e consistent with the principles of good planning. The location
and density were consider-ed at the time of draft plan approval and Staff
at-e of the opinion that they will not create a traffic hazard nor- will
they result in over-cr-owding of the public schools inasmuch as the School
Board was requested to comment on this draft plan and was satisfied that
the population proposed could be accommodated within existing and
proposed schools of the Cour•tice area.
With respect to the issue of pr•oper-ty values, we ar-e not in a position to
comment inasmuch as a pr-oper•ty appr-ai sal has not been submitted in
support of this opinion.
Staff have also met with the developer-, My-. Walter- Schleiss, who was made
aware of the resident opposition to townhouses being developed on these
two (2) parcels of land. My-. Schleiss has indicated that while he has
had some interest in constructing townhouses similar- to those illustrated
* on Attachment No. 2 to this r•epor•t, he is willing to consider- a change in
the plan to permit the development of 12 metre single family lots
provided the change does not result in any undue delay in the development
of this Plan. Staff note that all necessary approvals ar-e in place for
Mr•. Schleiss to proceed with development of these blocks for- townhouses

once the Third Phase of the Plan is r•egister•ed.
We note, they•efor-e, that there is no further- oppor-tuni ty for- a public
appeal of this particular, type of development and consideration of the
residents request would r-equir-e that the Council of the Town of Newcastle
pass a resolution requesting an amendment to the draft approved Plan of
Subdivision. If Council wishes to give favourable consideration to this
* request, we suggest that the resolutions included in Attachment No. 3 be
approved. Staff note however, that we do not support such a change and
that it is our- opinion that deletion of medium density housing
opportunities would be contr-ar•y to good planning and inconsistent with
the intent of the Town of Newcastle Official Plan. j

1. THAT the Ministry of Housing be requested to revise the draft
plan approval for Plan 18T-77001 to delete Blocks "C" and "D" for
link villas and to lot out these blocks to permit the development of
single family detached residential dwellings on 12 metre lots; and
2. THAT Staff be authorized to immediately initiate an amendment to
By-law 84-63, as amended, to rezone the referenced parcels of land,
Blocks "C" and "D", Plan 18T-77001 , to an appropriate zoning
category to permit the development of single family detached
dwellings having a minimum frontage of 12 metres per lot; and
3. THAT the Regional Municipality of Durham be requested to recommend
approval of the proposed red-line revision of Blocks "C" and "D",
Plan 18T-77001 to the Ministry of Housing.
