SUBJECT: DEVELOPMENT AGREEMENT

RECOMMENDATIONS:
It is respectfully recommended to Council the following:
1. THAT Report PD-146-86 be received; and
2. THAT Staff be authorized to amend the Development Agreement between the Town
and E. Pollard ( registered as Instrument No. 121104 in the Registry Office,
Newcastle) to facilitate an application for- Plan of Condominium.
BACKGROUND AND COMMENT:
On May 14, 1986, Staff met with representatives of the new owners of the proposed
apartment development originally submitted by Mr. E. Pollard as application DEV
83-22. At that time, it was indicated that it was their intent to submit an
application for Plan of Condominium and that an anticipated start date for
construction would be early August.
In order to facilitate such an application it is necessary to amend the current
Development Agreement to delete a condominium exclusionary clause and to reflect
relevant municipal requirements in respect of parkland dedication and construction,
and dedication of public streets. In all other respects it is anticipated that the

Development Agreement would remain the same. It should be noted that the
current agreement does not provide for any adjustment to development
levies save and except for those related to the rate of inflation.
Therefore, in the absence of specific direction to amend this aspect of
the agreement, the 1983 levies would apply with only modest annual
adustments to recognize inflation.
Inasmuch as the exact details of the proposed subdivision and relevant
condominium have yet to be received, it is difficult to identify the
extent of all necessary amendments to the Town' s Development Agreement.
In that regard, Staff are, at this time, only seeking Council ' s position
relative to the acceptability of this development proceeding as a
condominium as opposed to a rental project. If Council has no objection
to same it is, therefore, appropriate to amend our Development Agreement

accordingly.
A subsequent report outlining specific municipal recommendations and/or
conditions for condominium approval will be forthcoming upon receipt and
circulation of the relevant applications.
