HomeMy WebLinkAboutPD-159-86 TOWN OF NEWCASTLE REPORT File Res. # �¢ �• By-Law # METING: General Purpose and Administration Committee DATE: Monday, June 16, 1986 REPORT #: PD-159-86 FILE #: DEV 84-39 SUBJECT: APPLICATION TO REMOVE THE HOLDING SYMBOL FROM THE "(H)R1" - URBAN RESDIENTIAL TYPE ONE ZONE - HOLDING" KINGSBERRY PROPERTIES (FORMERLY REMLARK HOLDINGS) PART LOT 05, CONCESSION 2, DARLINGTON OUR FILE: DEV 84-39 I RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-159-86 be received; and 2. THAT the application submitted by Kingsberry Properties requesting the removal of the (H) Holding symbol from a parcel of land in Part of Lot V5, Concession 2, * former Township of Darlington, be approved and that the attached by-law hereto be forwarded to Council upon the Owner' s submission of a registered copy of the Subdivision Agreement entered into between the Town of Newcastle and Kingsberry Properties. BACKGROUND AND COMMENT: On December 7, 1984 the Planning Department received an application, submitted by Kingsberry Properties, requesting the removal of the (H) Holding provision on a parcel of land located in Part of Lot 35, Concession 2, former Township of Darlington (see * attached) . . . .2 REPORT NO.: PD-159-86 Page 2 As noted within Staff Report PD-6-85 acknowledging the application , the removal of the Holding symbol shall be upon Council being satisfied that the uses to be permitted will be adequately serviced, the lands to be used have adequate access, prior uses of the land will not prevent the use of the land for the purposes intended by the by-law, that the lands and proposed uses will be adequately protected from any physical or man-made hazards and conditions associated with the lands, and that the agreements in respect of such matters and the associated financial requirements, where required, have been executed with the Town of Newcastle and/or the Regional Municipality of Durham. In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies as noted in Staff Report PD-6-85. The following would summarize the comments received pertaining to the application. Central Lake Ontario Conservation Authority "Authority Staff have reviewed the above-noted rezoning application and offer the following comments for your consideration . In general , Authority Staff have no objection to the proposed rezoning for purposes of removal of the Holding symbol . Also, zone designations in accordance with those proposed on the draft plan are generaqlly acceptable, assuming that both Blocks G and H will be zoned (EP) to prevent the construction of buildings and structures other than those necessary for flood and erosion control . Some adjustments to the limits of the open space blocks, in particular Block H, may be required depending upon the details of the stormwater management plan and the lot development plans for those lots abutting Block H pursuant to conditions 19 and 20 of the approved draft plan of subdivision for this site. We trust that if such adjustments are required, the necessary changes in the zone boundaries will be made at the appropriate time. " Town of Newcastle Works Department "We have reviewed this application for Rezoning and find we have no objection to this proposal provided that: - The owner enter into a Development Agreeement with the Town; - Stormwater Management principles, as outlined in Courtice Stormwater Management Study are incorporated in the engineering of this developemnt to the satisfaction of C.L.O.C.A. and the Director of Public Works; . . .3 I r
