SUBJECT: EXEMPTION FROM PART LOT CONTROL
PLAN OF SUBDIVISION
FOSTER CREEK DEVELOPMENTS LIMITED

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-163-86 be received; and
* 2. THAT the attached by-law exempting Lots 13 to 17, 20 to 28, 30 to 34, 71 and 72 ( all
inclusive) , Registered Plan IOM-776 from Part Lot Control , be approved and forwarded
to the Regional Municipality of Durham pursuant to Section 49, Subsection (7 ) of the
Planning Act; and
3. THAT the applicant be so advised.
BACKGROUND AND COMMENT:
On December 18, 85, Staff received a request from Foster Creek Developments to permit the
construction of 'link dwellings on twenty-one (21) lots in Draft Approved Plan of
Subdivision 18T-19720. On February 3, 1986, Committee considered Staff Report PD-32-86
advising of the request and requesting approval of the changes necessary to the Draft

BACKGROUND AND COMMENT:
Approved Plan and the Subdivision Agreement in order to implement the request.
Committee resolved to approve the requested modifications (Resolution
#GPA-107-86). On February 10, 1986, this resolution was endorsed by Council
(Resolution #C-126-86 ) .
The subject plan of subdivision was registered on May 30, 1986 as Plan
10M-776. The link dwellings are to be constructed on Lots 13 to 17, 20 to 28,
30 to 34, 71 and 72 (all inclusive) of the Registered Plan and the Owner has j
requested the Town to exempt the lots from Part Lot Control . j
In order to facilitate conveyance of title of the individual link dwellings
located on these lots, it is necessary for Council and the Regional
Municipality of Durham to approve a by-law exempting the subject lots from
Section 49(5) of the Planning Act pursuant to the provisions of Section 49(7 )

of said Act.
* Staff have prepared a by-law (attached) providing the necessary exemption from
Part Lot Control . It is recommended that Council approve the attached by-law
and forward same to the Regional Municipality of Durham for approval .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 86-
being a By-law to designate a certain portion of a Registered Plan as not
being subject to Part Lot Control.
WHEREAS the Council of the Town of Newcastle deems it desirable to
exempt, from Part Lot Control, Lots 13 - 17, 20 - 28, 30 - 34, 71 and 72
(inclusive); of Plan 1OM-776, registered at the Land Registry Office for
the Land Registry Division of Newcastle (No. 10) on May 30, 1986;
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle
enacts as follows:
1. That Subsection (5) of Section 49 of the Planning Act shall not apply
to those lands described in Schedule "A" to this by-law.
2. This by-law shall come into effect upon being approved by the
Regional Municipality of Durham, and thereafter Subsection (5) of
Section 49 shall cease to apply to the lands described in Schedule
"A" hereto.
3. Schedule "A" attached hereto shall form part of this by-law.
