THAT Report PD-171-86 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and Administration Committee, Staff have * prepared the attached list of applications to the Committee of Adjustment for the meeting of May 28, 1986. This list includes the file number, applicant' s name, site location, type of variance requested, Official Plan Conformity, By-law Conformity, Staff' s canments on the applications and the Committee of Adjustment 's decision. Murdoch APPLICATIONS: A 22/86- 7 600646- ONTARIO- LIMITED,- LOT 20,- CONCESSION- 2,-DARLINGTON, . -. - Application was made for relief from zoning by-law requirements in order to permit the applicant to expand a legal non-conforming building by the construction of decks at the front and side and the restoration of the exterior of the building by the application of siding. Mr. Semple and Mr. Genereaux appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Heming, seconded by Mr. Rehder, "THAT as the proposed variance is in keeping with the intent of the Official Plan and Zoning By-law and would not have a detrimental effect on the surrounding neighbourhood but instead will enhance the area, therefore permission is GRANTED to expand a legal non-conforming use by the construction of decks at the front and side and the restoration of the exterior of the building by the application of siding. Moved by Mr. Reicheld, seconded by Mrs. Payne, "THAT as the proposed variance would appear to conform with the intent of the Official Plan and Zoning By-law, and as the new dwelling will be located on a wide 81 ft. road allowance, permission is GRANTED to construct a single family dwelling leaving a front yard of 30 ft. Moved by Mr. Rehder, seconded by Mr. Reicheld, "THAT as the existing lot could be severed into two lots with single family dwellings without creating any need for a variance, the Committee feel that the application for the proposed rear yard of 18 ft. Limited,_ Lot..10,_Concession_ ] ,_ Bowmanyille._ Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a commercial building, leaving a rear yard set back from Queen St. of .9 m, instead of the required 5 m rear yard and an exterior side yard from Lambert St. of .3 m, instead of the required 1 .25 m exterior side yard. Permission is also requested to reduce the landscape requirement from 10% to 5.34% and to permit parking spaces to within 0 m of the property line, instead of the required 1 .25 m to the property line. Mr. Horler appeared in support of this application. Mr. Locke, Mr. Elston and several other neighbours appeared with interest in, this application. No other person appeared in support of or in opposition to this applciation. Moved by Mr. Reicheld, seconded by Mr. Rehder; "THAT as the proposed Commercial Building would appear to conform with the intent of the Official Plan and Zoning By-law, permission is GRANTED to construct a Commercial Building ,leaving a rear yard to Queen St. of .9 m, and an exterior side yard from Lambert St. of.3 m. Permission is also GRANTED to provide 4% on site landscaping on condition that off site landscaping be provided to the satisfaction of the Town and to permit parking spaces to within 0 m of the property line, This application is conditional upon the applicant entering into a Site Plan Agreement with the Town. Moved by Mrs. Payne, seconded by Mr. Heming, "THAT as the requested variance would not appear to offend the intent of the Official Plan or Zoning By-law and would not appear to have a detrimental effect on the surrounding area this variance is considered minor and permission is GRANTED to continue the construction of a single family dwelling leaving a side yard of 1 m.
