SUBJECT: REZONING APPLICATION - RAY ABBOTT AND MURRAY MARCHANT
PART LOT 8, CONCESSION 7, FORMER TWP. OF DARLINGTON

RECOMMENDATIONS:
It is respec ully recommended that the General Purpose and Administration Committee
recommend to Council the following:
I . THAT Report PD-174-86 be received; and
2. THAT Application for Rezoning DEV 86-33 be tabled pending the receipt of all
comments, Council consideration of the Official Plan Amendment and the Development
Plan Amendment, further input from the applicant and area residents; and
3. THAT a copy of Council 's decision be forwarded to the applicant and all interested
persons previously requesting notice of same.
BACKGROUND:
On May 7, 1986, the Planning Department received an application submitted by Ray Abbott
and Murray Marchant to rezone a 15.5 hectare (38.3 acre) parcel of land in Part Lot 8,
Concession 7, Darlington from "A-1 Agricultural " to "RH-Residential Hamlet" to permit the
development of a residential subdivision.
The southerly 8 hectares of the subject land lie within the Hamlet of Tyrone and are
designated "Long Term Residential Expansion" by the Tyrone Hamlet Development Plan . The
applicants have also submitted an application to amend the Tyrone Hamlet Development Plan

to redesignate the lands within the Hamlet, as well as the remainder of the
subject land which currently lay outside the Hamlet boundaries, as "Short
Term Residential Expansion". A draft plan of subdivision (File: 18T-86007 )
proposing the creation of fifteen (15) lots has been submitted for the most
southerly 8 hectares of the subject lands; a further two (2) lots as
proposed by the plan of subdivision currently lay outside the hamlet
boundaries. The applicants have also submitted an application to the Region
of Durham (File: 86-39/D) to redesignate Tyrone as a Hamlet for Growth.
In accordance with departmental policy, the rezoning application was
circulated to various departments and agencies for comment. Most of the
comments have not been received as of the writing of this report. The
following is a summary of the comments received to date:

Town of Newcastle Community Services Department
"The present community/neighbourhood park for this Hamlet will serve as the
park for this subdivision. Consideration will be made next year to expand
the existing park. !

We recommend cash-in-lieu of 5% parkland dedication for this subdivision."
Region of Durham Health Unit
"Insofar as health matters are concerned, there are no objections to the
approval of the subject rezoning. However, the number and size of lots will
be determined when we have received formal application for approval of the
Plan of Subdivision. Please note that a preliminary examination of the plan
reveals that there may be some problems with Lots 6, 7, 8, 9, 10 and 17.
Also final grade and drainage plans should be included within the
application for subdivision."
The Town of Newcastle Fire Department and the Town of Newcastle Building
Department indicated no objection to the subject rezoning application.

Public Notice of the Rezoning Application was given in accordance with
Council policy and Planning Act regulations. As of the writing of this
report, no objections had been submitted specifically with respect to the
Rezoning Application. However, one (1 ) letter from an area resident had
been submitted in objection to the associated Official Plan Amendment
application.
COMMENT:
A Public Meeting with respect to the proposed amendment to the Hamlet
Development Plan submitted by the applicants was held at the General Purpose
and Administration Committee meeting of June 2, 1986. A number of area
residents appeared in objection to the application to amend the Tyrone
Hamlet Development Plan and the associated Official Plan Amendment
application to designated as a Hamlet for Growth. Their concerns related to
such issues as the impact on water supply, adjacent agricultural lands and
the character of the Hamlet.
Committee also considered Staff Report PD-151-86 which provided a summary of
the circulation comments and the findings of the Soils Report and
Hydrogeologic Assessment submitted by the applicant in support of the
application. Staff drafted a proposed amendment to the Hamlet Development
Plan (Amendment No. 2) which would extend the boundaries of the Hamlet and
would redesignate the subject lands to Short Term Residential Expansion with
a maximum of thirty-one (31) lots being permitted. Staff recommended that
Amendment No. 2 to the Tyrone Hamlet Development Plan be approved in
principle and forwarded to Council for final approval at such time as
Regional Council has considered the amendment and Official Plan Amendment
application 86-39/D has been approved by Regional Council .
Committee resolved (Resolution No .: #GPA-549-86) that Amendment No. 2 to
the Tyrone Hamlet Development Plan be denied. On June 9, 1986 Council

subsequently resolved (Resolution No.: #C-500-86) to table Amendment No. 2
to the Tyrone Hamlet Development Plan for two (2) months.
Given the decision of Council with respect to the proposed amendment to the
Tyrone Hamlet Plan, it is respectfully recommended that Rezoning Application
DEV 86-33 be tabled pending receipt of all comments and further input from
residents.
