POLICY STATEMENT

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-181-86 be received; and
2. THAT the revised criteria for identifying rural Nodes and Clusters annexed hereto
* as Attachment No. 1 be adopted by Council ; and
3. THAT a copy of the said criteria be forwarded to the Region of Durham Planning
Department for their information and records.
BACKGROUND AND COMMENT:
At the General Purpose and Administration Committee meeting of June 16, 1986 the Committee
considered Staff Report PD-168-86 in respect of Wylma Al li n 's application to pe rmi t the
development.
Within said report Staff advised that in consideration that the proposed cluster
application abuts an active agricultural operation , it was Staff' s opinion that the

approval of the rezoning application , as submitted, would not be in
compliance with the present Town criteria. Accordingly it was noted that,
although other facts would suggest that this is a classic example of
infilling, Staff were unable to support the application. Furthermore, Staff
noted that there had been two (2) applications of a similar nature recently
approved by Council notwithstanding the Town's criteria in respect of
location adjacent to agricultural operations. In view of this, Staff did
not provide a specific recommendation in order to permit further discussion
pertaining to Wylma Allin's application. In closing it was noted that if
Council is so inclined to approve the application, Staff suggested that
Council also consider reviewing this aspect of the criteria for Nodes or

Clusters. It is noted that the Committee, in consideration of Report
PD-168-86 approved of a recommendation to the effect that the application
submitted by Ms. Wylma Allin to rezone a 0.69 hectare parcel of land in Part
of Lot 20, Concession 1, former Township of Clarke be approved and a by-law
prepared and forwarded to Council for approval .
In consideration of same, Staff respectfully submits that the attached
revision to the criteria would be consistent with Council 's concerns and
previous decisions relating to Node/Cluster applications adjacent to active
agricultural operations. Staff would note that the present criteria does
require that any application for a Node or Cluster designation must comply
with the Agricultural Code of Practice. The revised criteria would, in
Staff' s opinion, clarify this requirement to the effect that should an
application be adjacent to an active agricultural operation, compliance with
the Agricultural Code of Practice would be necessary to be in compliance
with the Town' s criteria. Staff would note that such a requirement is
similarly noted within the Durham Plan; specifically Section 10.2.2.2 which
states that non-farm residential uses shall comply with the Agricultural
Code of Practice, as amended from time to time.

In consideration of the above, it is therefore respectfully recommended that
Council adopted the revised criteria as noted on Attachment No. 1 to Report
PD-181-86.

ATTACHMENT NO. 1 TO REPORT PD-180-86
TOWN OF NEWCASTLE CRITERIA FOR
IDENTIFYING RURAL NODES AND CLUSTERS
For the purposes of this policy rural Nodes or Clusters are
defined as areas of rural non-farm related residential
development which exhibit similar lot characteristics and
contain a minimum of three (3) and a maximum of six (6)
existing residential lots for which building permits would
be available and within which infilling may occur up to a
maximum of three (3) additional lots.
A rural Cluster shall be defined as areas bounded on, at
least, three (3) sides by natural or physical boundaries
such as watercourses or public streets.
A Node shall be defined as an area having a main focal point
such as a school , community centre, church or general
store.
In addition to the foregoing, rural Nodes or Clusters shall
not be permitted in areas designated as "Permanent
Agriculture Reserve" by the Regional Official Plan. In
other designations Nodes or Clusters shall not be permitted
in areas located adjacent to active, agricultural
operations, if such Node or Cluster does not comply
with the Agricultural Code of Practice or the setback
requirements of By-law 84-63, as amended.
