SUBJECT: REZONING APPLICATION - DURHAM REGION YMCA
PART LOT 27, CONCESSION 1, NEWCASTLE VILLAGE

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-183-86 be received; and
2. THAT Rezoning Application DEV 86-35 submitted by the Durham Region YMCA be
approved; and
* 3. THAT the By-law attached to this Report be forwarded to Council for approval ; and
4. THAT consideration be given to refunding the rezoning application fee to the
applicant.
BACKGROUND:
On May 5, 1986, a rezoning application was submitted by the Durham Region YMCA to permit
the operation of a day nursery within the Public Elementary School on Beaver Street,

Regional Official Plan and the Town of Newcastle Official Plan , and zoned
"(H)Rl" by By-law 84-63. The (H) Symbol was removed by By-law 86-41 which
is currently before the Ontario Municipal Board for approval . A day nursery
was established by the Durham Region YMCA in the Beaver Street Public School
in January, 1986. The Town subsequently advised the applicant that an
amendment to the Zoning By-law was required to permit the day nursery.
Staff are processing the application as a general amendment to By-law 84-63
to permit a day nursery as an accessory use to a public or private school .
A Public Notice advising of the amendment was published in local newspapers
on June 18, 1986; as well , notice was mailed to all property owners within
120m of the Beaver Street Public School and notice was posted on the
property. As of the writing of this report, no objection to the proposed
rezoning were received.
In accordance with Departmental procedure, the subject application was
circulated to various departments and agencies for comment. The circulation
also advised that the Town was processing the application as a general
amendment to By-law 84-63. The Region of Durham Planning Department advised
that the proposal would conform to Official Plan policies. The Public and
Separate School Boards, as well as the Ministry of Community and Social
Services, which is the provincial agency regulating day nurseries, indicated
no objection to the application. None of the other agencies circulated
indicated an objection to the proposal .
COMMENT:
Staff have no objection to the subject proposal and, accordingly, have
* prepared a by-law (attached hereto) to permit a day nursery as an accessory
use to a public or private school .

It is therefore recommended that Rezoning Application DEV 86-35 be appr oved
* and the by-law attached to this Report be forwarded to Council for approval .
Committee may wish to consider refunding the rezoning application fee to the
Durham Region YMCA inasmuch as the proposal has been processed as a general
amendment to By-law 84-63.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 86-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
I. Section 2 "Definitions" is hereby amended by adding to the
definition of "SCHOOL, PUBLIC" the words "and may include a day
nursery as an accessory use" following the word "Education" in the
second line.
2. Section 2 "Definitions" is hereby amended by adding to the
definition of "SCHOOL, PRIVATE" the words "and a day nursery as an
accessary use" after the word "school" in the fifth line.
3. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.
