SUBJECT: REZONING APPLICATION - E. VANDERWALKER
PART LOT 25, CONCESSION 1, NEWCASTLE VILLAGE

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-184-86 be received; and
2. THAT Rezoning Application DEV 86-34 submitted by Mr. E. VanDerWalker be approved;
and
* 3. THAT the By-law attached to this Report be forwarded to Council for approval ; and
4. THAT consideration be given to refunding the rezoning application fee to the
applicant.
BACKGROUND:
On May 14, 1986, a rezoning application was submitted by Mr. E. VanDerWalker to permit the
installation and operation of a bulk propane dispensing tank at the Newcastle Trailer Park

trailer park patrons only. The subject property is currently designated
"Residential " by the Durham Regional Official Plan and zoned "Special
Purpose Commercial (C4-8) Zone" by By-law 84-63. The "C4-8" Zone permits
the operation of a trailer park or trailer camp. The applicant has also
applied to amend the existing Development Agreement with the Town.
Staff are processing the application as a general amendment to By-law 84-63
to permit a propane dispensing tank as an accessory use to a Trailer Camp or
Park for the use of the park patrons only. Notice of the amendment was
published in local newspapers on June 18, 1986. As well , notice of the
proposed amendment was mailed to all property owners within 120m of the
Newcastle Trailer Park and a sign advising of the application and the Public
Meeting was posted on the property. As of the writing of this report, no
objections had been received with respect to the proposed amendment.
In accordance with Departmental procedure, the subject application was
circulated to various departments and agencies for comment. The circulation
advised that the application was being processed as a general amendment.
The following is a summary of the comments received:
Town of Newcastle Fire Department
"No objection. Application and installation is to be in accordance with
established practice and procedures and comply with "Installation Code for
Propane Burning Appliances and Equipment CAN-1 B1492M80 and Ontario
Regulation 825/82.
Plans should be submitted for approval to the Ministry of Consumers and
Commercial Relations, Fuel Safety Branch. "
Region of Durham Planning Department
"lhe proposal does not appear to be in conflict with policies in the Durham
Regional Official Plan and the Official Plan of the Town of Newcastle."
Ministry of Transportation and Communications
"No objection. The proposed installation must be setback a minimum of 25
feet from the Highway No. 2 right-of-way. The applicant must obtain the
necessary permits from this Ministry. "

The following agencies indicated no objection to the proposed amendment:
- Town of Newcastle Public Works Department
- Town of Newcastle Building Department
- Newcastle Hydro Electric Commission
- Ganaraska Region Conservation Authority
- Region of Durham Health Unit
- Ministry of Agriculture and Food
COMMENT:
Staff would have no objection to processing this application as a general
amendment to By-law 84-63 and, accordingly, have prepared a by-law
(attached) to permit a propane dispensing for the use of trailer park or
camp patrons as an accessory use to a "Trailer Park or Camp" as defined by
By-law 84-63. The By-law amends the provisions of the "Special Purpose
* Commercial Exception (C4-8) Zone" and the "Agricultural Exception (A-11)
Zone" to permit a propane dispensing tank as an accessory use for the use of
trailer park patrons only subject to the provisions for Bulk Fuel Storage
Tank location as given under the "Service Station Commercial 0 )" zone.
Staff are also processing an amendment to the existing Development Agreement
with the applicant to permit a propane dispensing tank at the Newcastle
Trailer Park. Other trailer parks or camps as permitted by the "C4-8" Zone
and the "A-11" Zone will also be subject to Site Plan Control should they
wish to install such facilities.
It is therefore respectfully recommended that Rezoning Application DEV 86-34
be approved, and that the By-law attached to this Report be forwarded to
Council for approval . Committee may wish to consider refunding the rezoning

application fee to the applicant inasmuch as the application has been
processed as a general amendment to By-law 84-63.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 86-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
I. Section 19.4.8 is hereby deleted and replaced with the
following:
"SPECIAL PURPOSE COMMERCIAL EXCEPTION (C4-8) ZONE
Notwithstanding Section 19.1, those lands zoned C4-8 on the
Schedules to this by-law shall be subject to the following zone
regulations:
PERMITTED RESIDENTIAL USES
a. trailer park or trailer camp in accordance with the -
provisions of Section 6.4.11 hereof, including a propane
dispensing tank as an accessory use for the use of park
patrons only in accordance with the provisions of Section
19.3 hereof.
PERMITTED NON-RESIDENTIAL USES
a. a retail sales and/or service establishment with outdoor
display areas for recreational vehicles, equipment and
accessories in accordance with the provisions of Section
19.3 hereof."
2. Section 6.4.11 is hereby amended by adding thereto a new
subsection e. as follows:
"e. a propane dispensing tank as an accessory use for the use
of park patrons only in accordance with the provisions of
Section 19.3 hereof."
3. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act.
