THAT Report PD-185-86 be received; and 2. THAT Rezoning Application DEV 86-27 be lifted from the table and approved; and * 3. THAT the By-law attached to this Report be forwarded to Council for approval ; and 4. THAT a copy of Council ' s decision with respect to this matter be forwarded to the applicant and interested parties as indicated hereto. BACKGROUND: On June 16, 1986, a Public Meeting was held with respect to Rezoning Application DEV 86-27 submitted by Josie Doxtater and Dorothy Hartford on behalf of the Estate of Mary Ethel Lycett to permit the severance of two (`L) additional residential lots on private services in Part Lot 28, Concession 5, former Township of Clarke (Orono ) . Committee also considered Staff Report PD-161-86 which recommended that the application be tabled pending . . .2 REPORT NO.: PD-185-86 Page 2 the receipt and approval of the application. Committee resolved (Resolution #GPA-599-86) to adopt the recommendation. Committee' s recommendation was subsequently endorsed by Council on June 23, 1986 (Resolution #C-539-86 ). The Engineering Report was submitted by the applicant on June 9, 1986. The findings of this Report indicate that the subject site is suitable for the proposed development. In particular, the Report notes that a stratum of free-draining, clean fine sand predominates in the likely area of the proposed waste disposal leaching beds and would be ideally suited for soil absorption of septic effluent. The Report recommends a number of measures to enhance subsurface absorption of sewage effluent. The Report also states that ample supplies of potable groundwater should be readily obtainable and recommends drilled wells, at least 15m deep be provided. The Report concludes that no negative impact upon existing water supplies should result j from the proposed development. Staff circulated the Report to the region of Durham Health Unit for review. The Health Unit indicated that they have no objections to the proposed rezoning. A letter identifying a number of concerns with the Engineering Report was submitted to the Town by three (3) area residents. Staff circulated the letter to the Health Unit for comment. The Health Unit advised that they reveiwed the letter and were still satisfied with the Engineering Report. CONVENT: I Staff have no objection to the proposed rezoning and severances inasmuch as the Regional Works Department has advised that municipal water services will not be available to the subject lands and the proposal constitutes minor j * infilling. Accordingly, Staff have prepared a By-law (attached) to rezone the subject lands to permit the severance of two (2) residential building lots on private services. The related severance applications (LD 333/86 and LD 334/86) were tabled by the Land Division Committee on June 16, 1986 pending submission of an Engineering Report and the Town' s consideration of the rezoning application. Should the by-law attached to this report be approved by Council , Staff will forward revised comments to the Land Division Committee indicating no objection to the proposed severances subject to the payment of the appropriate development charges and the zoning by-law becoming final and binding. It is respectfully recommended that Rezoning Application DEV 86-27 be approved and that the By-law attached to this Report be forwarded to Council for approval . Respectf itted, T.T. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule "13" to By-law 84-63, as amended, is hereby further amended by changing to "R1-13" the zone designation of the lands indicated as "ZONE CHANGE TO R1-13" on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this by-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
