THAT Report PD-189-86 be received; and 2. THAT the proposed amendment to By-law 84-63 included herewith as Attachment No. 1 be approved. BACKGROUND AND COMMENTS: Arising from recent circumstances involving expansion and enlargement of existing residential dwellings and as a result of an actual situation involving an expansion and enlargement of a dwelling which did not have an adequate sanitary waste disposal system, Staff have given consideration to an amendment to By-law 84-63 which would have the effect of requiring installation of an appropriate water supply and sanitary waste disposal system as a prerequisite to the expansion and enlargement of existing residential dwellings not presently possessing a suitable system or with a system of an adequate size to accommodate the proposed expansion. This amendment is consistent with the intent of the Town' s Property Standards By-law and is a further means of controlling the expansion and enlargement of dwellings which do not currently have an adequate system for disposing . . .2 ov �"� REPORT NO.: PD-189-86 Page 2 of human sanitary waste material . In accordance with Committee Resolution #GPA-1045-84, Staff have initiated a Public Notice in respect of the proposed amendment and have scheduled a Public Meeting for the General Purpose and Administration Committee meeting of July 21, 1986. A copy of the Public Notice, which was published in * various newspapers having local circulation, is attached hereto for the information of the Committee. Staff are proposing an amendment to Section 3.18 "Servicing Requirements", as presently contained within By-law 84-63 which states as follows: "3.18 SERVICING REQUIREMENTS Unless otherwise provided herein, no residential building or structure may be erected and no use may be established in any zone unless the lot upon which it is situated is serviced by a private potable water supply system installed in accordance with the requirements of Health Protection and Promotion Act and a private sanitary waste disposal system installed in accordance with the requirements of the Ministry of the Environment." As presently written , this section would only prohibit the construction of new dwellings and Staff are proposing to add thereto wording appropriate to prohibit the expansion and enlargement of any existing residential building or structure unless it can satisfy the same requirements as a new dwelling unit. July 11, 1986 Chi r PUBLIC NOTICE CORPORATION OF THE TOWN OF NEWCASTLE PUBLIC NOTICE TO ITS CITIZENS AMENDMENTS TO THE TOWN OF NEWCASTLE'S COMPREHENSIVE ZONING BY-LAW 84-63 Pursuant to Section 34(12) of the Planning Act and in accordance with Regulation 404/83, notice is hereby given of a Public Meeting to be held on July 21 , 1986 in respect of proposed amendments to By-law 84-63, the Town of Newcastle's Comprehensive Zoning By- law. The subject amendments would: 1. permit day nurseries as accessory uses within elementary or secondary schools; 2. permit bulk propane storage and.dispending tanks as acces- sory uses to Trailer Parks or Trailer Camps for the use of the Trailer Park or Trailer Camp residents only; tfjroi7M a det`inition of Special Events and Recreational Compe- titions and define the iones.within which such uses would be permitted;and 4. require the approval of the Durham Regional Health Unit for any expansion or alteration of an existing residential dwelling or proposed residential dwelling to be serviced by means of a pri- vate sanitary waste disposal system. WHEREAS the Council of the Corporation of the Town of Newcastle deems it desirable to amend By-law 84-63 in order to prohibit the expansion and enlargement of existing residential buildings or structures unless such building or structure is serviced by a private potable water supply and a private sanitary waste disposal system; NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of Newcastle enacts as follows: 1) Section 3.18 of By-law 84-63, as amended, is hereby further amended by adding the words "or no existing residential building or structure may be enlarged, extended or reconstructed" following the word "erected" in the second line thereof. 2) This By-law shall come into effect on the date of passing hereof subject to the provisions of Section 34 of the Planning Act, 1983.
