RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-023-03 be received;
2. THAT the rezoning application submitted by Dickinson & Hicks Architects Inc. on
behalf of St. Anthony of Padua Parish, be APPROVED;
3. THAT the amending By-law attached be forwarded to Council for approval;
4. THAT a copy of Report PSD-023-03 and the attached amending By-law be
forwarded to the Durham Region Planning Department; and,
5. THAT all interested parties listed in this report and any delegation be advised of
Council's decision.

1.0 APPLICATION DETAILS
1.1 Applicant: Dickinson & Hicks Architects Inc. (Ivan Dickinson)
1.2 Owner: St. Anthony of Padua Parish (Father Gerry Campeau)
1.3 Rezoning: To rezone the subject lands from "Agricultural (A) Zone" to an
appropriate zone to permit the construction of a 1798 m2 place of
worship and manse.
1.4 Site Area: 2.78 ha
2.0 LOCATION
2.1 The subject lands are located at 1862 Bloor Street (Attachment 1). The property
is contained within Part Lot 26, Concession 2, in the former Township of
Darlington.
3.0 BACKGROUND
3.1 On October 22, 2002, Ivan Dickinson of Dickinson Hicks Architects Inc., on
behalf of St. Anthony of Padua Parish, submitted an application to the
Municipality of Clarington to rezone the subject lot at 1862 Bloor Street to permit
the construction of a 1798 m2 place of worship and a manse.
3.2 The owner's intent is to construct a place of worship, containing the church, two
classrooms, chapel, offices and a related parking area. In future, a manse will
also be constructed.
3.3 A Public Meeting was held December 2, 2002 at which time an abutting property
owner raised concerns with development of a place of worship on this property.
Section 7 will discuss resolution of these concerns.

4.0 SITE CHARACTERISTICS AND SURROUNDING USES
4.1 The subject property contains an existing single detached dwelling and a
detached garage which will be removed if the application is approved by Council.
The property has frontage and access to Bloor Street currently. The proposed
place of worship will have access only from Hancock Road.

5.0 OFFICIAL PLAN POLICIES
5.1 The Durham Region Official Plan designates the subject lands "General
Agricultural Area". The proposed place of worship conforms with the policies of
the Regional Official Plan.
5.2 The Clarington Official Plan designates the subject lands "General Agricultural
Exception" and "Environmental Protection Area". Section 13.3.5 specifically
permits a place of worship at the northeast comer of Hancock Road and Bloor
Street. The proposed place of worship use conforms with the policies of the
Clarington Official Plan.
6.0 ZONING BY-LAW CONFORMITY
6.1 The subject lands are currently zoned "Agricultural (A)", which permits a variety
of uses, including an existing place of worship. A new place of worship would not
be permitted, thus the need for the rezoning application.

7.0 PUBLIC SUBMISSION
7.1 Mr. John Waters, appeared at the public meeting (December 2, 2002) and
submitted a letter to the Municipality of Clarington detailing his concerns.
Planning Staff responded by letter to which Mr. Waters appears to be satisfied
that his concerns will be addressed through the site plan approval process. His
concerns included lighting, noise, possible school, size of manse, protection of
the environment and the location of future entrances.
8.0 AGENCY COMMENTS
8.1 The Clarington Building Division has indicated they have no objection to this
development proposal providing all site plan concems are addressed through the
site plan approval process.
8.2 Clarington Emergency Services, Regional Police Services, Bell Canada, Ministry of
Transportation and Regional Planning have no concerns with the proposed place of
worship at this location.
8.3 Regional Health Department has no objection to the proposed rezoning as their
concems are being addressed through the site plan approval process.
8.4 Clarington Engineering Services, Regional Works and Central Lake Ontario have
no objection to the rezoning application and has given the applicant a number of
comments to address to meet prior to site plan approval.
8.5 The Ministry of Transportation (MTO) has no objection to this application.
However, MTO asked that the Clarington Planning Services Department ensure
that the applicant be made aware that the future Highway 407 East Clarington Link
is adjacent to the property. Also, as this highway has not yet received approval
under the Environmental Assessment Act, MTO cannot ensure the final location of
this highway will not affect the property through proximity or expropriation. Planning

Staff have advised the applicant of this concem, and St. Anthony's has determined
to continue with their plans at this site, at this time.
9.0 COMMENTS
9.1 The applicant is proposing to construct a 1987 m2 place of worship. The
drawings indicate it will be a single storey building containing the main church,
two smaller chapels, a gift shop, two classrooms, gathering room and associated
church offices. In the future, a manse (rectory) will also be constructed in a
separate building.
9.2 The applicant has also concurrently submitted an application for site plan
approval (SPA2002/047), indicating number and location of parking spaces,
landscaping, signage and entrance location.
9.3 The applicant has provided a detailed storm water management plan, prepared
by Marshall, Macklin and Monaghan, reviewing both storm water quality. Central
Lake Ontario Conservation, Clarington Planning Services and Engineering
Services Departments have reviewed this report and are satisfied that storm
water has been adequately addressed and will be implemented through the site
plan approval process.
9.4 An Environmental Impact Study (EIS) is generally required for development
occurring within 50 metres of top of bank for cold water streams. An on-site
meeting in October with Central Lake Ontario Conservation, Clarington Planning
Services Department, Marshall, Macklin & Monaghan Consultants, a
representative of the church and the agent was conducted to assess visually the
Tooley Creek tributary. The tributary was dry and there is no discernible creek
bed or top-of-bank. The site plan for this property indicates that development will
generally occur on the western portion of the property, a minimum of 41 metres

from established tree line. Municipal and Conservation Authority staff are
satisfied that an EIS is not warranted in this instance.
9.2 The Municipality shall require, through the site plan process, the dedication of the
tributary lands. As there is no discernible creek bank (or top of bank) the land
dedication shall include lands from the eastern property limits to 5 metres west of
the drip line of the established tree line. A survey of the proposed land
dedication has been submitted and reviewed to the satisfaction of both Central
Lake Ontario Conservation and Clarin9ton Planning Services.
10.0 CONCLUSIONS
10.1 Based on the comments contained in this report, it is respectfully recommended
that the rezoning application be APPROVED.

BY.LAW NUMBER 2003-_
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for
the former Town of Newcastle
WHEREAS. the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-law 84-63. as amended, of the Corporation of the former Town
of Newcastle to implement ZBA 2002-034;
NOW THEREFORE BE IT RESOLVED THAT, the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Section 6.4.71 "SPECIAL EXCEPTION - AGRICULTURAL EXCEPTION (A-71)
ZONE" is hereby amended by adding thereto the following new Special
Exception 6.4.71 as follows:
"6.4.71
AGRICULTURAL EXCEPTION (A-71) ZONE
Notwithstanding Sections 6.1, those lands zoned "A-71" on the
attached Schedule to this By-law, may also be used for a place of
worship and a manse. For the purposes of this subsection a
manse shall mean a dwelling for a clergy person:
2. Schedule "1" to By-law 84-63 as amended, is hereby further amended by
changing the zone designation from:
"Agricultural (A) Zone" to "Agricultural Exception (A-71) Zone" as illustrated on
the attached Schedule "A" hereto.
3. Schedule "A" attached hereto shall form part of the By-law.
4. This By-law shall come into effect on the date of the passing hereof, subject to the
provisions of Section 34 of the Planning Act.
