REPORT NO: CLD-41-03 PAGE 2 of3 BACKGROUND On September 3D, 2003, at approximately 1 :30 p.m., Mr. Ronald Williams was walking past a dog leashed outside Hair Fitness at Clarington Corners. As he was walking past the dog to go to the convenience store, he said "Hello Puppy" to the dog. He saw the dog turn his head then felt him bite at his pants as he walked in to the store. Upon entering the store, he asked if the dog belonged to anyone in the convenience store. No one did, so he went into Hair Fitness and Mr. Dagnall, the dog's owner, was having his hair cut. According to Mr. Williams, Mr. Dagnall had an "I don't care" attitude about the situation. Mr. Williams called the Animal Shelter and kept watch of where Mr. Dagnall went. Upon the officers' arrival, Mr. Williams advised them that the person they were questioning was in fact the person that he had been speaking to earlier. Mr. Dagnall adopted his dog (a pit bull named "Bang Bang") from the shelter on August 29, 2003. The officers had concern at the time of the adoption as they felt the dog might be aggressive around young children. After discussing the matter with Mr. Dagnall on two occasions, he still wanted to adopt the dog and agreed that it would not be in contact with children. After investigating the situation with Mr. Williams and Mr. Dagnall, an Order to Restrain was placed on the pit bull, which requires Mr. Dagnall to: 1. licence and register the dog with the Clarington Animal Shelter and have the dog permanently identified by microchip implantation 2. notify the Animal Shelter staff immediately upon relocating the dog or upon transferring ownership of the dog 3. restrain the dog at all times, while the dog is on its own property, by keeping him enclosed in a pen or other enclosure in such a manner as to prevent the dog from leaving the property and to prevent contact with people and other animals . REPORT NO,: CLD-41-03 PAGE 3 OF 3 4. restrain the dog at all times, while the dog is off its own properly, with the use of a muzzle and a leash no longer than 6 feet and under the care and control of a person who is 16 years of age or older. On October 3. after being served with the Order to Restrain, Mr. Dagnall attended at the Animal Shelter and picked up the Dog Attack/Bite Report, which dog owners are to complete following an incident. At the time of preparing this report, Mr. Dagnall had not filed the paperwork. Mr. Williams has completed and filed the appropriate documentation required of a person involved in an attack/bite. Mr. Dagnall has appealed the Order to Restrain and will be addressing Council on October 20, 2003. Mr. Williams will also be addressing Council.
