BACKGROUND
On July 10, 2003, Durham Regional Police attended at 54 Parkway Crescent to investigate a
report of a dog bite. At approximately 12:30 that day, Ashley Thornton, age 11, was riding her
bike in front of 77 Ontario Street on the east sidewalk when she was knocked off her bike by a
large rottweiller. The dog stood over Ashley barking at her and bit her on the right hand. A
neighbour came running out to the sidewalk to scare off the dog, who belongs to Phil Carlton
of 77 Ontario Street. A friend of Mr. Carlton was at Mr. Carlton's residence and called off the
dog and put her in the house. The neighbour checked to see if Ashley was hurt, then followed
her home to 54 Parkway Crescent in his truck as Ashley rode her bike.
Ashley was taken to Bowmanville Hospital to have her right hand examined by medical staff.
The doctor who examined Ashley told her that the bite had not gone through all of the extemal
layers of skin, but the doctor expressed to Ashley's father that we was going to file a report to
have the dog quarantined.
When contacted by the police constable, the neighbour stated that he did not see the dog
knock the girl off the bike but did see the dog approaching Ashley in an aggressive manner
while she was lying on the ground crying. He stated that the dog has been at the residence for
approximately three years and he has never seen the dog on a leash. Approximately two
years ago, he had his mail delivery stopped for three days because the letter carrier was afraid
of the unleashed dog.
The Police reported the incident to both the Durham Region Health Department and to Animal
Services. The Health Department issued a Confinement Order for the dog for the period of
July 11 to July 21, 2003. An Order to Restrain has been placed on the rottweiller, which
requires Mr. Carlton to:
1. licence and register the dog with the Clarington Animal Shelter and have the dog
permanently identified by microchip implantation

2. notify the animal shelter staff immediately upon relocating the dog or upon transferring
ownership of the dog
3. restrain the dog at all times, while the dog is on its own property, by keeping them
enclosed in a pen or other enclosure in such a manner as to prevent the dog from
leaving the property and to prevent contact with people and other animals
4. restrain the dog at all times, while the dog is off its own property, with the use of a
muzzle and a leash no longer than 6 feet and under the care and control of a person
who is 16 years of age or older.
Mr. Carlton is in compliance with Item 1. of the above requirements in that the dog is licenced
and microchipped.
When the Animal Services Officer discussed this matter with Mr. Carlton on July 17, he
indicated that he would not muzzle a dog or keep it contained-he would have the dog
euthanized. This has not happened, and Mr. Carton has decided to appeal the Order to
Restrain. He will be addressing Council regarding this matter on September 29, 2003.
Mr. Thomton will also be addressing Council.
