While walking past #3 Champine Square, a male golden retriever named Captain lunged at her. Kayla was left with scratches. red marks and bruises on her arm and has suffered from arm aches. She did not receive medical treatment for the injuries. The owners of the dog, Meghan Jamieson and Jeff Fyfe, have indicated that they were in the front yard with the dog and the dog was leashed at the time of the incident. A letter from them is included herewith as Attachment No.1. Upon discussing the incident with the dog owners and Teresa Foote, the mother of the child involved, the Animal Services Officer has indicated that the dog does seem to get very aggressive. The dog owners have stated that the dog originally came from an abusive home. An Order to Restrain has been placed on Captain. The order requires Mr. Fyfe and Ms. Jamieson to: 1. licence and register the dog with the Clarington Animal Shelter and have the dog permanently identified by microchip implantation 2. notify the animal shelter staff immediately upon relocating the dog or upon transferring ownership of the dog 3. restrain the dog at all times, while the dog is on its own property, by keeping it enclosed in a pen or other enclosure in such a manner as to prevent the dog from leaving the property and to prevent contact with people and other animals 4. restrain the dog at all times, while the dog is off its own property, with the use of a muzzle and a leash no longer than 6 feet and under the care and control of a person who is 16 years of age or older. '-- REPORT NO.: CLD-24..Q3 PAGE30F3 Mr. Fyfe and Ms. Jamieson are in compliance with Item 1. of the above requirements in that the dog is licenced and microchipped. They have indicated their desire to address Council regarding this matter on June 9, 2003. Mrs. Foote will also be addressing Council. Interested parties to be advised of Council's decision: Mrs. T. Jamieson 3 Champine Square Bowmanville, Ontario L2C 4V9 .. :'O:3MfW2:3 hn10 Attachment No. 1 To Report CLD-024-03 Dear Sir / Madam: May 21st 2003 Please accept this letter as formal application of appeal in regards to restrictions placed upon our dog. This appeal is being made on the following basis. 1- Our dog is always kept in our fenced yard, except when being exercised. At this time he is always on a leash. 2- Our dog is still considered a puppy and is very playful. 3- The alleged bite that occurred did not break any skin and the dog was actually playing with the child. If the dog was in any way attacking surely the skin would have been broken if only for the sheer size of the dog. 4- The dog was on a leash at the time and in our control on our property. Unfortunately the young girl came onto our property while our neighbours children [who regularly play with the dog] were playing. Our neighbours children have no fear of the dog and often playa little rough with him. 5- We are currently looking to enroll our dog in a CKC approved obedience course. 6- We plan to continue exercising him using the muzzle as he response better to control. 7- We have made arrangements to take the dog to a Vet that specializes in behavioral issues to have him professionally assessed and if necessary treated as well. 8- Most importantly, we plan to have a family of our own and in no way do we want a dog that will present any kind of danger to our children. We would be happy to provide you with the names and phone numbers of our neighbours whose children regularly play with our dog as character references. We truly regret this incident and are prepared to accelerate our training efforts. We will also be more conscious of his playing habits and handling in public.
