BACKGROUND
On February 10, 2003, at approximately 9:00 a.m., James and Justin Zegers were asked by
their mother to go out to their field and try to catch two dogs who where barking and nipping at
their horse. One of the dogs is an Akita-Shepherd cross, the other is an Akita-Collie cross.
The horse was trying to kick at the dogs, but they would just move away for a few seconds and
then return. The horse had drool on her legs but no cuts or bites were noticed. According to
the boys, the owner of the dogs drove up the road, stopped his car and yelled at the dogs.
The dogs then ran back to the property where they are kept.
The owner of the dogs, Mr. Farkas, has provided his account of this incident, which is attached
as Attachment No.1.
In response to the incident, Mr. Farkas has been charged with two counts of failing to licence
his dogs and two counts of allowing an animal to trespass as well as having an Order to
Restrain placed on the two dogs.
The order requires Mr. Farkas to:
1. licence and register the dogs with the Clarington Animal Shelter and have the dog
permanently identified by microchip implantation
2. notify the animal shelter staff immediately upon relocating the dogs or upon transferring
ownership of the dogs
3. restrain the dogs at all times, while the dogs are on their own property, by keeping them
enclosed in a pen or other enclosure in such a manner as to prevent the dogs from
leaving the property and to prevent contact with people and other animals
4. restrain the dogs at all times, while the dogs are on their own property, with the use of a
muzzle and a leash no longer than 6 feet and under the care and control of a person
who is 16 years of age or older.
Mr. Farkas has indicated his desire to address Council regarding this matter on April 28, 2003.
Ms. Zegers will also be addressing Council.
