THAT Report CLD-15-03 be received; 2. THAT Mosport Park be exempted from Section 2. (h) of By-law 78-50, as amended, for the upcoming 2003 racing season; 3. For the 2003 season, applications have been received for: . Stock Car Racing - Mosport Oval Track - 18 Saturday nights, May 10 through September 6 . Mosport Roadcourse . Victoria Day Trans-Am - May 16-18 . Cascar Event - June 13-15 . Vintage Races - June 27-29 . Motorcycle Racing - July 18-20 . Grand Prix Alms Event - August 14-17 The licencing by-law sets out various requirements which must be met prior to licences being issued. In respect of racing events at Mosport, the by-law requires, in part, that Mosport provide: . written evidence from a professional engineer that the maximum level of audible sound measured at four noise monitoring locations shall not exceed certain levels as outlined in the by-law; and . an agreement to save the municipality harmless and indemnify it from any costs, charges, expenses and liability that it may incur as a result of monitoring of sound levels, either by municipal employees. contractors or consultants. In 2002, Council exempted Mosport from the requirement that they retain the services of a sound engineer to provide the evidence that the sound levels will not exceed the limits set out in the by-law. This was due to the fact that the complaints had decreased so significantly since the requirement was added to the by-law. It is recommended that this same exemption apply to the licences for the 2003 season. Mosport has agreed to cover the municipality's costs for sound monitoring as needed.
