THAT Report EGD-32-03 be received; 2. THAT subject to any representations at the public meeting respecting the opening of the road allowance between Darlington Township and Clarke Township described as Part 23 of Plan 10R-1330, the road allowance will be dedicated as an open public highway at such time that the road has been improved in accordance with the provisions of the Amending Agreement between Ridge Pine Park Inc. and the Municipality of Clarington, respecting Phases 1 to 5 of the Wilmot Creek Development; 3. THAT once the Amending Agreement has been executed between the Municipality of Clarington and Ridge Pine Park Inc., the conditions of the Amending Agreement have been met and the road has been improved in accordance with the provisions of the agreement, respecting Phases 1 to 5 of the Wilmot Creek Development the said road allowance will, further to a subsequent report, be dedicated by by-law as an open public highway. Cannella Director, Engineering Services Reviewed by: (]- ~ ~ Franklin Wu Chief Administrative Officer ASC*jb September 2003 CORPORATION OF THE MUNICIPALITY OF CLARINGTON 40 TEMPERANCE STREET, BOWMANVILLE, ONTARIO L 1 C 3A6 T (905)623-3379 F (905)623-0830 REPORT NO.: EGD.32-Q3 PAGE 3 1.0 BACKGROUND 1.1 Further to Report EGD-25-03, a public meeting is necessary in order to satisfy the requirements of the Municipal Act for the opening of the said road allowance between Darlington Township and Clarke Township, described as Part 23 of Plan 10R1330. 1.2 The opening of the road allowance requires improvements to the roadway prior to the dedication of the road as public road highway and the passing of the appropriate bylaws to enact it as such. 1.3 The applicant, Ridge Pine Park Incorporated is responsible to improve the subject road through the provisions of the Amending Agreement, the conditions of which provide the framework for the construction of the subject road. Representatives of Ridge Pine Park Incorporated have met with Municipal staff and together they have agreed on the scope of the road improvements necessary to meet our Municipal Rural Road Standards and Specifications. At the present time the Amending Agreement has not yet been executed by Ridge Pine Park Incorporated. 1.4 Before the passing of the appropriate by-laws to dedicate Part 23 of Plan 10R- 1330 as a public highway the applicant, Ridge Pine Park Incorporated will be required to execute an Amending Agreement with the Municipality of Clarington respecting improvements to the road. Once the road works and the required maintenance period have been completed satisfactorily Ridge Pine Park Incorporated will be required to obtain a Certificate of Acceptance from the Director of Engineering Services, at the Municipality of Clarington, in accordance with the conditions of the Amending Agreement. CORPORATION OF THE MUNICIPALITY OF CLARINGTON 40 TEMPERANCE STREET, BOWMANVILLE, ONTARIO L 1C 3A6 T (905)623-3379 F (905)623-0830 , REPORT NO.: EGD-32-03 PAGE 4 2.0 RECOMMENDATIONS 2.1 As the purpose of this report is to satisfy the requirements of the public meeting required under the Municipal Act and taking into consideration the comments received, it is respectfully recommended that this matter be referred back to staff for future processing of the road opening application in conjunction with execution of the Amending Agreement and the subsequent assumption of the road and dedication as a public highway and the preparation of a subsequent report.
