1.0 BACKGROUND

1.1 The purpose of this report is to provide the General Purpose and Administration
committee with an annual update on information regarding site plan applications
that have been submitted for approval.
1.2 The Site Plan Control By-law requires that plans and drawings for any building or
structure be approved by the Municipality prior to issuance of a building permit
except for those exceptions stated in By-law 90-130. By-law 90-130 delegates
the approval authority of site plan applications to both the Director of Planning
Services and the Director of Engineering Services.
1.3 Except for additions or minor expansions, a site plan agreement is generally
required for a proposed development to ensure a comprehensive design review
of the location of all buildings and structures, landscaping, access permits,
parking areas, signage and grading etc., by all regulatory authorities. In addition,
it is through the site plan approval process that the Municipality collects its cash-
in-lieu of parkland dedications, road widenings, performance guarantees, etc.
Each agreement is registered on title and is enforceable against present and
future owners.
2.0 SITE PLAN ACTIVITY
2.1 Attachment 1 to this report outlines all active site plan applications during the
period of January 1, 2002 and December 31,2002. The summary table includes
the following information: site plan application file number, the applicant's name,
the nature of the application, location, current status and approval date (if
applicable). There are separate summary tables for Bowmanville, Courtice,
Newcastle Village, Darlington and Clarke.
Approval may be conditional on agreements being signed by the applicant,
executed by the Mayor and Municipal Clerk and then registered against title.
Until registration occurs, a building permit is not usually available.

2.3 In comparison to past years, 2002 was a relatively busy year. Chart 1 shows the
total number of site plan applications per year since 1996. 2002 saw the second
highest number of applications submitted.

2.6 There are 51 files open at year end 2002. Some have been recently received
and are in circulation for comments from other departments and external
agencies. Others have been open for longer periods. These tend to be more
complex applications, often requiring more time for identifying issues and for
resolving concerns. In most cases, applications that have been open for several
months require the submission of additional information or revised drawings.
2.7 In 2002, four site plan applications were appealed to the Ontario Municipal Board
(OMB). All of these applications are located along Highway 2 or King Street, with
two in Courtice and two in Bowmanville. One is for an office use within the area
of the proposed Courtice Highway 2 Corridor Secondary Plan. The other three
are for drive-through restaurants, where the applicants and Municipality are in
disagreement over traffic impacts and appropriate measures to address traffic
concerns.
There are six open applications for telecommunications towers. Recent policy
approved by Council for New Telecommunications Antenna and Towers calls for
a letter of undertaking from the applicant. In these cases, initially site plan

approval was on hold until the policy was finalized; now in most cases, staff is
waiting for the submission of the letter of undertaking or other information from
the applicant.
Two applications have stalled because of Regional requirements for road
widenings. One of these applications is on Highway, east of Bowmanville, where
the road widening would require the demolition of an existing dwelling on the
property. The other is on Taunton Road and the conveyance of property would
reduce the parking available for a restaurant use.
Site plan files awaiting information are monitored regularly by the assigned
planner and a letter is sent informing the applicant of the status of the file. Staff
continue to make a concerted effort to clear the number of older files by resolving
issues or by closing files due to inactivity.
