THAT Report PSD-003-03 be received; and 2. THAT Council concurs with decisions of the Committee of Adjustment made on December 5, 2002 for applications A2001/063, A2002/068 and A2002/069 and that staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment. All applications received by the Municipality for minor variance are scheduled for a hearing within 30 days of being received by the Secretary-Treasurer. The purpose of the minor variance applications and the Committee's decisions are detailed in Attachment 1. The decisions of the Committee are detailed below: DECISIONS OF THE COMMITTEE OF ADJUSTMENT FOR DECEMBER 5, 2002 Application Number Staff Recommendation Decision of Committee A2001/063 Table Tabled A2002/068 Approve Approved A2002/069 Approve Approved 2. Application A2001/063 was previously tabled at the December 2001 meeting for up to one year to allow the applicant time to resolve site plan issues. Although the applicant has not yet submitted a site plan application, they have been working to resolve site plan issues such as parking and driveway access and now feel they will be ready early in 2003 to apply for site plan approval. The application was tabled by Committee for up to three (3) months. 3. Application A2002/068 was previously tabled to the December 5, 2002 agenda as the measurements originally submitted on the application were incorrect. A site inspection verified a deck and steps in the rear yard also required a minor variance. Staff and the applicant verified the location of the property line and a new public notice was mailed, a new sign posted and a new public hearing scheduled for December 5, 2002. 4. Application A2002/069 was amended at the Committee of Adjustment meeting November 21 , 2002 to include a shed in the rear yard of the property that did not meet the interior side yard setback requirements. The amended application was approved. 617 REPORT NO.: PSD-003.03 PAGE 3 5. Staff has reviewed the Committee's decisions and is satisfied that the applications that received approval are in conformity with the Official Plan policies, consistent with the intent of the Zoning By-law and are minor in nature and desirable. Council's concurrence with the Committee of Adjustment decisions is required in order to afford staff's official status before the Ontario Municipal Board in the event of an appeal of any decision of the Committee of Adjustment. 6. At the last meeting, the Committee made the following appointments: . Due to Susan Ashton's maternity leave in 2003, Allison Ruddock has been appointed as an Acting Secretary-Treasurer for the period of Susan's leave. . Due to the promotion of Carlo Pellarin to the Manager of Community Planning and Design, Larry Taylor was appointed as the Acting Secretary-Treasure to attend in the absence of Allison Ruddock.
